Anti-Piracy Law Firm Targeted Clearly Innocent People

ACS:Law ex-employee confessed she quit her job due to the feeling that the law firm targeted clearly innocent people like old ladies, who could only be guilty of failing to protect their wireless connection, but not downloading files.

The story of ACS:Law and its mass lawsuit campaign goes on with the news over an ex-employee quitting the job due to moral concerns. She said that she gradually became aware that some of the targets were clearly innocent. Some of the accused were, for example, elderly people who didn’t even know how to download content – they simply didn’t establish protection of their Wi-Fi.

As for the law firm itself, it proudly called the new “pay-up-or-else” business model “revolutionary”, and claimed that such approach will generate revenue for copyright owners and effectively decline the level of copyright violation in a sustainable way. The new model was opposed by the “costly and ineffective” efforts of their rivals. However, from the very start it became evident that lots of innocent people ended up targeted.

After the law firm launched its first lawsuit, the largest consumer body in the United Kingdom reported that over 150 innocent people had already been targeted, including a 78-year-old man, from whom the firm demanded nearly $800 for a porn file he was suspected to have downloaded. Of course, an individual in question never knew what file-sharing is, which means he couldn’t do this himself or give anyone else permission to do that.

Meanwhile, the ACS:Law’s owner, Andrew Crossley, has been defending his company’s approach, claiming that he didn’t know of any innocent people being targeted. In addition, he truly believed that the new approach was necessary to “eradicate” unauthorized file-sharing. To prove this, he emphasized the opportunity to enter into compromise which they offer at the very beginning in order to avoid a trial by agreeing to settle for around $500-800.

The main problem with the new approach, as well as with the old one, is that the company only identifies an IP address, but not the actual individual who is responsible for the violation.

The consumer body Which? has even complained to the UK’s Solicitors Regulation Authority that the law firm was involved in “bullying”, which resulted in having Andrew Crossley being referred to the Solicitors Disciplinary Tribunal.
