The new legislation is currently discussed by the government. It would provide the Department of Justice with the power to force American-based 3rd parties like broadband providers, search engines, payment processors, and Internet advertising networks to block access to illegal websites or even stop doing business with them. Besides, copyright owners would also be provided with extra tool to address infringing websites.

After facing a number of failures while attempting to fight illegal file-sharing, rights owners now decided to try another plan of attack by restricting freedom of online movement. Apart from having seized over a hundred of domains within the ongoing “Operation in Our Sites” campaign, the government is now pushing a suggestion able to drastically escalate the effort.

A new legislation, named “Preventing Real Online Threats to Economic Creativity and Theft of Intellectual Property Act of 2011,” also known as the “PROTECT IP Act,” would provide the Department of Justice and rights owners with extra instruments against copyright violating sites.

The law will work as the following: if the Department of Justice initiates the lawsuit, the Attorney General is granted the right to force American-based 3rd parties like Internet service providers, search engines, payment processors, and Internet advertising networks to prohibit access to illicit sites or simply stop doing business with them. Meanwhile, if the lawsuit is initiated by a rights owner, the list is limited to payment processors and advertising networks, without ISPs and search engines.

New legislation outlines such “safeguards” as allowing domain name or site operators to petition the court in order to have the orders vacated. However, this can only be done after the fact and the damage done. In other words, it’s like being sentenced before trial.

Another interesting issue is search engine censoring: it actually means that search engines would be forced to censor all kinds of unauthorized content and websites. This may include such illegal websites an online gambling, but it’s unclear whether it would address the services promoting drug usage. Finally, the legislation encourages voluntary censoring of online services reasonable believed to be engaged in infringing activities.

conmac863 avatarDo you think they realize it will not work even if it gets passed? Soooo many ways around this. The only ones that will really be affected by it are the people that are not pirates but are doing genuine research into "censored" subjects.

I guess it is a feel good move. "See what we are doing.. see how we are working hard to protect big busine... I mean protect the public"

savlon3 avatarhi folks, about a year ago i was getting very bad downloads and i tryied changeing my settings on u,torrent but i still got about 40kb/s download from this site and others , then i come across vpn and i am born again its the best peace of mine i ever had, my speed is now 800to 900 kb/s download and i can get up to 70kb/s up more if i need to and its the same all the time 24hours daily, it cost me $70 about £50 in english money a year , i love it and i have no problems with it , you get a lot more but i cant say , but what i can say is no more worys about uploading your torrent, you can if you want to, what you get is you are downloading to another country try this

D4T4 avatarI think the key is in the words "American-based 3rd parties". savlon3 has the right idea about using a VPN to leave the country and cover his tracks and I'm sure the other sites will all move off-shore, as indeed our beloved ET has everything in place to do just that. TDaddy avatarVPN service has become VERY expensive over the past year. The prices have risen from $30 USD per year to $180 USD a year in some cases. If this is the way of things then it's just going to be worth it to go back to the "Blockbuster" method (rent and copy), just like the old days.

chasnjas avatarIts just a waste of time,trying to shut this down.The reason people d/l is because they refuse to pay $30+ *australian * for a new dvd,i can just go to any local market and get an illegal copy for $6,if they shut down all torrent sites the blackmarket will just dvd rip everything and sell them at a fraction of the cost of buying them in the shop.Also..people who go the movies go because of the experience,even though i d/l i also go to the movies,wether to take the missus for a night out or to take the kids to see something they really wanna see,shutting down these sights wont increase numbers going to movies one iota...*goes off to google best dvd ripping program*

what about the price of gas? why do oil companies need to make hundreds of billions of dollars profit even if there is no oil shortage or reason for the prices to be so high? go after those companies. but no, especially since the republicans protect the big corporations and their shareholders at the expense of the american people.

How will an ISP or Attorney general decide which sites will be filtered? and how fast will they rule on site address?!? Its just a waste of taxpayer money is all...

Infectious avatarSo not only is the government forcing people to pay almost $5.00 dollars for a gallon of gas but now they will be spying on everyone's internet activity as well,the way it's going America won't be a democracy it will be Communist ran.Wonder if it has ever occured to any of these entertainment industry people that with money being in short supply these days(at least for the poor and middle class citizens)maybe people cant afford to pay $7 to $10 dollars(or more in some areas)per ticket to go watch a film in a cinema.Maybe if they would quit making everything more expensive every time you turn around it would at least "slow"alot of the file sharing down a bit and more people would actually go to a cinema to see a film.I have 6 children so you could imagine what a night at the movies would cost me.The way I see it is that they are doing it to themselves and even if they somehow figured out a way to magically stop people from file sharing do they think that we all will just start paying their prices to go see their films in an over-priced cinema?Alot of people just sinply can't afford to go.
