The country’s Justice Minister Simon Power claimed that even though the report of the United Nations called access to the Internet a fundamental right, the government is quite satisfied with the new copyright legislation and isn’t going to reconsider the law.
The news is that the New Zealand government will not reconsider disconnecting people from the web, even after the UN report. Indeed, Justice Minister assured the citizens that he was satisfied with the copyright legislation as it currently stands.
Two months ago, to the dismay of many, the government enacted The Copyright Bill to fight online infringement. The law allows for penalties of up to $12,000, plus stipulates the suspension of Internet account for up to 6 months.
But a week ago the report was published by the UN’s Special Rapporteur on freedom of opinion and expression. The report in question concluded that disconnecting people from the web, regardless of the justification provided, is basically an infringement of the International Covenant on Civil and Political Rights. Shortly after the report publication Labor communications spokesperson claimed that it was time for a review of the New Zealand’s copyright legislation, thus agreeing with the UN’s conclusions that web disconnection violates international law. Meanwhile, the Green Party reacted to the announcement by calling the change of heart “a little rich,” while agreeing how important the connection to the worldwide web has become to people’s daily lives.
However, today Justice Minister has easily brushed aside all those concerns, saying that he was quite satisfied with the new copyright legislation as it was written. He specified that he wasn’t planning to reconsider the law that the government passed just a few weeks ago, because the latter was thoroughly consulted over 2 years. Justice Minister said he was confident that the draft of the law has been through every test and every forum to become what it is today. In addition, Simon Power admitted that he hadn’t really thought of whether or not web access is a basic right as the report of the United Nations claims. On the other hand, he believes that the agreement between Internet service providers and copyright owners was satisfactory. The only problem is that the agreement in question excludes the public.

wow glad I dont live in NZ...that's some bs, I agree with the UN. It's a right just like freedom of speach, with out the net alot of things wouldnt be possible to do now of days.
Well here's yet another example of big "brother" in action;I wonder how he would react if his human rights were infringed?
No doubt he would comply with the law no matter how unfair it is....whats that? oh yes of course how stupid of me, he would get it changed ...time for these sort of politicians to be voted out once and for all.
the power is in the hands of the voters so they say, yeah right! if they don't keep the pledges that got them elected then they just make lame duck excuses, because they know that the real power is in the system they created and promote regardless of what political affiliation they claim to hold. "say what you like to the voters to get in, then do what you like to feather your own nest at their expense"..oh what aloverly world these pillars of society are creating for us victims to live in.

If you want change .. vote them out of govt .. election is this year... QUOTE: When the government fears the people, there is liberty. When the people fear the government, there is tyranny. Thomas Jefferson (1743–1826)
the internet is not a right it is a priveledge, just like having a driver's license is a priveledge not a right...and even if you have rights they can be taken away look at us in the U.S.A I cant the "n" word, so that means my right of free speech has been hindered/ taken away...the U.N is all B/S and all of the problems here in the U.S.A can be traced back to civil rights...it is not a right to be treated equal it is a priveledge...1488
i say vote the sob out of office and while you are at it check and see if he is living above his means and if he gets a job with these dummies bring him up on charges that he was taking bribes, ask for him to take a lie detector test and get the law pass that he has to and i bet he would quit tonight, he has been bought and paid for and still taking your tax payer dollar. start a investigation into his life and get ready to be surprised.

its not too bad first the "industry" have to catch u then notify isp then 3 of these and yuor in ther sh1t, if ur d/l torrents u should be using a privacy or a blocking service no matter where u live. I use peer guardian, which blocks known anti p-p organisations RIAA etc. if you're that concerned buy yourself a vpn connection.
wifi theft, is connecting to your neighbours un (or poorly) secured wireless network in order to access their internet connection but can be detected when suddenly thay start going over their cap every month and look at who is connecting to their router.

I'm in NZ too and this makes me sick!this government is acting more and more like the US Government everyday, changing laws at the drop of a hat for off shore corporates whilst giving us the voting public the middle finger.Helen Clark did the same thing to get her cushy UN post after she was defeated by Shon-key last election.
We have had taxpayer funded referendums where 90% of the public votes against a new law and they just thumb there noses at us with contempt and do as they please anyway!
I don't know how this law can be defended as you are presumed guilty upon accusation,if you deny it the recently passed laws to require our data is retained means they will probably just ask the tribunal to release your web browsing history to prove your computer was responsible.
That still does not prove that i did anything wrong as an IP address does not equal a person just an address, but because the police won't be involved i'd say the threshold for the J.P to side with Nzf*ct will be very low, they won't need to examine my computer or router for evidence because these Tribunals will be fast!!!They'll have to be to keep up with demand from the Copyright industry. So what is left but their word against our word?
The law requiring tribunals instead of court cases will mean no lawyers can be present, except i'm sure the NZF*CT rep will no doubt have alot more legal knowledge than the average torrent user! How this can be said to be a fair law is beyond me and when my time comes if Peerblock doesn't save me I will be telling these Fascists what they can do with their fines,i will sell everything i own before i would pay these leeches one cent.I have no problem closing my bank accounts to prevent the government from getting an attachment order on my income,i am very resourceful and i will fight back until i am given a fair trial infront of a jury of my peers where the evidence gathering techniques used by these villans can be properly scrutinized!
Sorry for the rant,i think ive got it out of my system...for now!
Is there any defence in ancient laws as he Magna Carta or the Bill of Rights Act 1688?

at least u get a warning, then u know pb not working anymore.
having this bill passed under urgency is wrong, a waste of taxpayer money and prove that our system is no longer a real democracy
nz political process need urgent review, ordinary kiwis and common sense are just not being considered any more.
i assume the referendum you reference was the one on the anti-smacking bill, that hasnt stopped kids being killed by caregivers and now kids are more out of control, you cant even threaten them with it anymore cos they laugh and say not allowed to smack me smart ass little shits would probably be the best thing you could do for some of them
i think we need a revolution in this country!!!

and for voting them out, theyre all the bludy same except the current opposition (labour) is even more pathetic, without a strong leader and have no morals or backbone either
I like how some of you people talk about voting people out and democracy. That is a big joke there is no such thing, Who are you going to vote in? Just the other guy that is paid by the same lobbiest group! There is no choice, no matter who you vote for he is paid to be there and their vote is for the highest bidder. NZ will not change because they make huge amounts of cash so movie producers can film there. The only true democracy is Voluntary Virtue
