The Motion Picture Association launched its first test case of UK’s Digital Economy Act of 2010?s provision which allows rights owners to petition the High Court in order to obtain an injunction against a broadband provider and force it to prevent access to some websites involved in copyright infringement.

The MPA has just started its case in the UK High Court of Justice, trying to convince a judge that the country’s Internet service provider BT should be forced to block well-known British Usenet indexing site Newzbin.

The provision the outfit refers to is Amendment 120a(1), and it isn’t the first time Usenet indexing website has been targeted by the pro-copyright organization. A year ago Newzbin lost a copyright infringement case, followed by its going into administration in attempt to sort out a pile of debts including costs of the trial, damages, and other debts the service owed to third parties. Nevertheless, as any other file-sharing service, the site soon reemerged as Newzbin2 hosted in Sweden.

The reason why the MPA chose BT is apparently to take advantage of its Cleanfeed system that had been launched 7 years ago to target kids porno. An unidentified spokesperson for the Motion Picture Association confirmed that this particular ISP had been chosen because it was the largest in the country and already had the technology in place, via its Cleanfeed system, to block access to the website. If the current case proves successful, the MPA hopes that other broadband providers would take note of the result.

Meanwhile, the case in question is part of an overall campaign started by the copyright owners, including those from the United States, to create a “great copyright firewall” and prevent subscribers from accessing infringing content on the Internet.

Although the websites accused of infringement were granted by the MPs a provision offering them the right of appeal, many of those services will simply be unable to afford the luxury of appearing in a British courtroom. The same criticism was also made against bills drafted in the United States, including the COICA and the more recent PROTECT IP Act, where rights owners hope to block access to illegal websites.

Apparently, if the High Court approves the first copyright owners’ request, they are expected to initiate a whole bunch of requests for websites to be blocked by Internet service providers.
