After being litigated by Universal Music Group, Veoh Networks won as a federal appeals court handed down the decision in their favor. Last week the court ruled that if the site operator can successfully keep users from publishing copyrighted content, they aren’t responsible for copyright violation.
The lawsuit in question was watched attentively by the entertainment industry: by winning, Veoh Networks have really set a precedent, because it is the first national case that managed to reach the appeal court. As a result, a federal panel in the US is currently considering an appeal filed by Viacom in a similar copyright case launched against YouTube.
Launched 5 years ago, Veoh Networks lets its users to publish videos on their site. However, the service does instruct the users not to publish copyrighted content. In addition, the company is using filtering means in order to remove more than 60,000 copyrighted videos. However, even despite all those precautions, the company acknowledges that a number of copyrighted videos have been downloaded from their website. Back in 2007, Universal Music Group filed a lawsuit against Veoh Networks, claiming that their protective tools were insufficient and that the firm knew, or should have been aware, that its users have uploaded copyrighted videos and music that belong to Universal Music Group.
The Ninth U.S. Circuit Court of Appeals of San Francisco didn’t agree with the claims of the entertainment industry and exonerated Veoh Networks, deciding that the company was eligible for “safe harbor” under the DMCA. In reply, Universal Music Group argued that Veoh Networks knew that the uploaded content was copyrighted, and that’s why the firm should be held liable. However, the court didn’t change their opinion and decided that since Veoh Networks complied with deleting the copyrighted content it cannot be guilty.
Judge Raymond Fisher said in the 3-0 ruling that rights owners knew exactly what content they own, and therefore are better able to identify violating copies than such service providers as Veoh Networks. In their response, Michael Elking, representing Veoh Networks, claimed that the court’s decision was an important victory for the digital media marketplace.

|liable for what? God people fail to see the BIG PICTURE. Movies are CRAP, music is CRAP and television is CRAP. You want people to buy things - make it worth it. Stop releasing 5 movies in theaters every friday and 10 on dvd the following tuesday. At 20$ for two people to see a movie WITHOUT FOOD of any kind (jack it up to 40$ then!!) who the hell has the money for all this? I remeber when stars had ONE big movie a year - how the "F" does Nic Cage have 5 in a year (especially when they ALL SUCK and no one wants to see that crackhead anymore). You want people to buy cd's again? Maybe release some good music. Maybe looking back - people got tired of paying 25$ or more for garbage music... A keyboard and a mac does NOT a musician make. Prince said it best - the commercialization of the music industry is what brought it down - that and oversaturation. My over all point it - people will pay for quality. I haven't bought and movie or cd (aside form 2 or 3 maybe) in almost 10 years... hollywood thinks because someone downloaded a movie they lost money. Who says they were gonna pay for it anyways? Instead maybe this guy who downloaded a movie saw it and (like me) told all his friends with money who still got to movies to see that one. They fail to even see the benefit word of mouth can give... There's so many factors... plus the format warring. I've seen/bought Return of The Jedi: in theaters twice, on vhs THREE times, dvd one AND NOW BLURAY? Kiss my a$$ George Lucas - I downloaded it FOR FREE! I have that right now - and he has enough f'ing money. I DESERVE to watch Jedi anytime I want FOR NOTHING - I've paid into ENOUGH times already...|

|The_Ritty - You are hilarious! I love it. You said everything that I do on a daily basis. There are so many movies that I have bought on each new format that comes out. You are right, they can suck it! I have paid for the same movie so many times.|
|I'll also add another point as well. You have a good radio and listen to music; yet you might record that music broadcast over the air by the radio stations.|
Now are you a pirate? Did you violate any copyrights?
There were no legal notices before and after EACH song stating basically recording this song is a copyright violation so you would be subject the fines and penalties?
Now one step farther; YOU upload it to a torrent?
TV shows do have a copyright notice at the end of the show so they COULD sue you.

|well back in the 80's in the uk when the top 20 was playing on the radio every weekend they broadcast a warning telling you not to record it as it was illegal not sure about now as i dont listen to the radio anymore as the play crap music|
|i remember that santa the top 40 and john peel late at night back in the 80's .smoking me mums fags i nicked and drinking over the green with me mates listening to the tape player of the top 40 on me c90 tdk casette haha the good old days|
|copyright laws r stupid why is it downloading albums and movies free is stealing but listening to full albums and watching movies online isnt your still saving £16 because you aint buying anything|
