Recently, Motion Picture Distributors Association (MPDA) India has issued a report about the pirates like us that India is the Fourth Largest Illegal Downloader of Online Content just behind the US, Britain and Canada in online copyright crime that’s less serious than a felony. This is the proof of a fact that Indians are downloading TV and film content very frequently through the web-based file hosts and networks which provide online file sharing. Jyoti Taneja, advocate, representative of author JK Rowling in India, says, “But this amounts to theft under Section 63 of the Copyright act, and is punishable under Indian Penal Law.” The one who commits such crime would be fined anywhere between Rs. 50,000 and Rs. 200,000 along with imprisonment between six months to three years.

For Youth of India, downloading movies, songs and TV serials through the online file sharing networks has become just a daily dose and a big part of their lives. They don’t even want anyone to ask them if someday they would have to leave such life. They yell at such question. The youngsters have always found accepting to illegally downloading their music, movies, books and software.

Some of them were caught aside and asked about it. Namit Khanna*, 19, a Delhi University Student says, “We don’t have the money to go and see every movie in a theatre. It takes 5-6 hours to download a movie via Torrent and I can watch it the same weekend it’s released.” And, Hitesh Arora, 29, said, “We used to download Bollywood movies all the time when were studying in the UK. We saw all the Indian TV serials and movies on our laptop. I really didn’t think much about IPR, perhaps because my budget was tight and I couldn’t spend much to go and watch a movie in a hall.”

pirate.png

The Justifications used by the downloaders has always been only one thing that’s “Tight Budgets”. But according to Taneja, “This doesn’t stand valid in a court of law. Though, students have never really been taken to court. In the UK, notices were put on file sharing networks advising students not to download content illegally. But even there, the fine levied was nominal, to avoid a public outcry.”

In India, Movie “Kaminey” of Vishal Bhardwaj, Director was recorded to have been downloaded at least 350,000 times on BitTorrent, with around two-thirds of the downloaders located in India. There have been a great loss to the multiplexes of at least Rs 5,25,00,000 in such illegal downloads if the average cost of a movie ticket is supposed to be Rs 150.

CHANDNA ARORA, Times News Network, India asked five young people about the stuff pirated by them.

MOVIES: Twilight, New Moon
BOOKS: None
MUSIC: Most of it is pirated
SOFTWARE: Legal
- S Sharma, 26, medical student

MOVIES: I rent CDs and DVDs, most of which are pirated
BOOKS: The Da Vinci Code
MUSIC: I don’t remember when I last spent money on music
SOFTWARE: All my software is pirated too, including my OS
– Vaibhav Bhatnagar, 23, copywriter

MOVIES: Twilight, Up, Rocket Singh are some recent ones
BOOKS: Lots. I had many pirated versions of graphic novels back in college – The Sandman series, Watchmen, V For Vendetta – in soft copies
MOVIES: All of my music is pirated
SOFTWARE: Now I have legal software, but in college I had many pirated anti-virus software – Nord and AVG – and many movie players
– Ankita K, 24, lawyer

MOVIES: Many. I last downloaded Twilight, 300, The Dark Knight
BOOKS: Many audio books. I have the Harry Potter series, Twilight and Men Are From Mars...
MUSIC: I’ve stopped buying CDs. Almost all of my music is pirated
SOFTWARE: Legal
– Advaita, 26, online market researcher

MOVIES: Many. Avatar, 2012, Underworld…
BOOKS: Not really.
MUSIC: I bought a few legally for the quality of the sound, but otherwise, almost all of my music is pirated.
SOFTWARE: I don’t use illegal software on my company machine, and on my personal machine, I have Linux.
– Nipun Kumar, 26, software engineer

(*Some names changed on request)

See, Indian's are growing up their interest over illegal downloading. One of the advantage they get from the file-sharing networks is that the movies which are not released in India, most of the times it has already been released in other countries and the pirates in other countries release them in file-sharing networks in kinds of CAM, TeleSync, DVDSCR etc. and they can download it easily from there even before the release of movie in the theaters in India. Is't?

Best of luck to the Indian Pirates from none other than "Extra Torrent". Keep raising up your interests. "The Biggest BitTorrent System - Extra Torrent" appreciates that.

jenga122 avatarThe thing that gets me is they always say that downloaders have cost this movie $xxxx.xx amount of money. I go to the movies more now than I did before I started downloading. I am selective and most of the material I view I would have never seen in the theater to begin with. P2P helps promote the art of the cinema and it does get you hooked. Nothing compares to seeing an excellent film on the big screen with the theater sound. I personally have just become a better informed consumer. Create better movies and your profits will soar. Plain and simple. Nice article. For those in India where the movies and music aren't even current...can you blame them? Who wants to be years behind the current anything. Time to watch Avatar on my Black and White 13" tube. LOL.

from total population of 1.3 billion only 8% people use Internet Regularly
From that 8% only 1% are familiar with bit torrent its indeed a newbie for indians considering that most of the internet surfers are illiterate and only can do what they are tought to do
About Law: There is no justice here absolutely not and i mean it LAW was made and kept aside to be used for powerful and rich,You ask an indian the defination of justice he wud reply "What is it???some kinda fish found on MARS"

carolina avatarThe REAL thing is, Those student DO NOT HAVE THE MONEY to go see movies. Then HOW is this money that never existed lost? How are the ticket sales lost if the persons supposedly NOT buying them do NOT have this phantom money in the first place???????? It's a classic case of counting your chickens (tickets) before they are hatched (bought). For the people who use downloads to find a movie they WANT to spend money they DO have, this actually INCREASES (as in jengas case) the number of times a person ends up going to the movies. I for one know that there are movies I see advertised that I thought, naaaa not interested. Then because I wanted to help seed I downloaded it and opened it to check quality and got hooked into watching. (sometimes not but alot of times yes) Then I realize how much better it would be on the big screen and with my family. There you go a ticket sale that did not EXIST till I saw the movie on download.
Thats why Movies sales are on the INCREASE even in this economy. For godsakes Avatar made a BILLION dollars in SEVENTEEN days. It was available within days after its theater release! What can they really be losing?

carolina avatarP.S. If everyone thought like this, counting "lost" revenue then music would not be put on radios, or CD's or any other media. Movies would not be put in theaters and DVD's. Books would not be printed or put on audio cassettes. If everyone wanted to be SURE to be paid for every time their "artistic endeavors" were used (as in read, seen or listened to) then EVERY performance would be LIVE ONLY. That way every performance would be on a paid basis without a chance to "pirate" them.

aryanaraish avatarHey this article just points out to one part of the problem. The real problem with indian cinema is that they "DONT HAVE ORIGINAL SCRIPTS" ALL I mean ALL their films are take off on hollywood films. And when they are questioned they say....well we were "Inspired"...By making a hash out of the original script!. We need more stringent laws on these so called self proclaimed "Star" directors and producers. "HOLLYWOOD ARE YOU LISTINING IN...

No avatarto me the problem is that there is not enough quality out there to justify paying to go watching a movie at the cinema all the time, out of 50 - 60 movies i ve downloaded in the last 12 months i ve bought 10 legally because they were top quality films, i wouldn t of actually bought the others in the first place and after watching them i wouldn t recommend em to anyone to buy unless they want to be bored to tears. TV shows are another medium that create a rod for their own backk when heroes was being broadcast the same week as in america last year i didn t download it because i knew there wasn t a massive wait but supernatural is nearly finished in america by the time it hits here and THEN you have to find the right channel its on because it has jumped channels 3 times in my country and then when you find the channel they put it on when they feel like it and not a guaranteed time slot, i do buy the boxsets whenm they come out but i m not waiting that long to be able to keep up with my favourite shows, so hollywood one simple rule if you don t want some things downloaded illegaly look at your ticketing prices give us some way of seeing some of a film so we know if its worth our valuable time and money to go and watch at the cinema and as for tv well just give yours heads a wobble and make the gap between countries broadcast dates a little smaller

kaiser_Chief avatarFor all these media moguls who whine an have a fat cry about how their revenues are getting reduced because of Piracy, please reduce your greed and be more creative and make better movies.. the cash will still follow. Through File Sharing (I won't call it piracy), we have the a sort of filter that we didn't have earlier.. Now we go to the theaters and watch all the good movies..like the Dark Knight and Star Trek.. rather than spending $10 for a real crappy one...And although international movies are released at almost the same time in India as it is in the US, the sitcoms takes months or even years.. so what does one do? Sit around reading positive reviews in the journals?

Next thing you know.. maybe sharing a newspaper bought by one person and given to his friend, maybe considered "illegal" file sharing and adequate royalty demanded.

KazzGirl avatarThanks for the article EMUworld. I still go to the movies even though I download some. There is nothing better than watching a GOOD movie on the big screen with loud sound. But there are so many times I have watched a downloaded movie only to say "I am so glad I did not pay to see that!" Hubby even says it now - its a running joke. I think Hollywood is starting to using downloading piracy as a "catch all" for crappy movies that just dont make the money they want. Its easier to blame the P2P'ers than be emotionally mature enough to accept that the movie they made just wasn't good enough. Money will always follow quality films as people will recommend a good film to friends and family, and warn others not to see a crappy one.

As a side note it kinda makes sense that Inida would be right up there in the piracy list as there are many Indian peoples and as more and more jobs go over there that require computer skills, more and more Indians will be buying and using more computers. The economic demographic of the country is well below that of most first world countries, so it makes sense they would download rather than pay for a movie ticket.

Thanks again EMUworld.

and now cos of torrents i bought 5 cds! which i would have never had

jason9ine avatarGood read.

Why am I not surprised? Well maybe because Indians living in the Philippines whom are also called "Bombay" in native Filipino dialect have been using the piracy to their advantage for years now. You know.. Download, mass produce/burn in cheap DVD-R worth 4 pesos(Approx. US 8 - 12 cents/pc) using some kind of modified burner and sell it to the market for 30 - 40 pesos(55-80 cents/pc) Since the Philippines government is not at all strict about the anti-piracy rule, which I think they just don't give a shit rather than being "Not strict", they earn hundreds of millions a year.

I'm not being racial. If you are, in anyway, offended by my post I appologize but no offense intended. Really. :)

paragbhau avatarThe interview given here is somewhat misleading and not properly canvasses the correct picture in the contemporary India.
Here, the movies which are released(which are in very large number) are most of the times not watchable in the theater. Why on earth somebody will spend money on an idiotic movie just to watch it in theater. So the best option for such movies is to get them downloaded.
Its not the matter of having "tight pockets" but its just a proper management and calculated with justified spending of money.
And on the other hand there are those movies like '3 idiots'(I watched twice in theater)which if not watched in theater is one's bad luck.Thats it.
Learn this trick from us.......u people need it.

paragbhau avatarNo avatar Dear EMU, take it in proper sense. You cant like every movie. It is a personal choice. What you said is a game of words I often play. Its just like that.....
Let me give you an example-the movie 'AAMRAS' which I downloaded from ET was so bad(script was bad) that it proved to be a flop on the very first day of its release in theater.Such movies can be seen only by downloading. No need to spend money on it in theater.
This is what i mean by idiotic movies.......its the story of the movie and not the quality of the print which is being uploaded.I have always appreciated the effort of uploaders of movies.
SO friend, next time interpret my comments carefully......
and hey is it between you and me........
I am just one of the fans of ET and there is no need to get angry.I just wanted a clarification 'coz it was beyond my ken............
please let me have it.
