42 year-old Robert L. Henderson from Grandview, Missouri, drew investigators of Motion Picture Association of America sting suspicions because he was wearing a warm winter coat, not quite appropriate for July, then confronted by them after the movie and detained by police.
Last October Henderson pled guilty to penal copyright violation for recording “The Dark Knight” movie using a video camera at its opening weekend and also for selling contraband DVDs. He has been sentenced to 2 years in prison and has to pay $24,738 as compensation to the Motion Picture Association of America.
The investigators seized 1,240 bootleg DVDs from Henderson that were presumed to have otherwise been sold out, so the MPAA would have been deprived of their profits in amount of $24,738 (which is $19.95 for each DVD).
Chief of Operations for the Association stated that stealing films by camera recording was a real threat to the motion picture industry’s health and thereby to 2.4 million Americans employed by it. MPAA hopes such an appropriate punishment for such a serious crime will be a warning to prospective movie thieves that they’ll face rigorous consequences for these activities. They are also very grateful to those who were involved in the detention and prosecution of the defendant, as the theater cam-cording was made a federal felony in 2005.
Missouri Man was caught in an MPAA sting after it sent investigators to Lee’s Summit, Missouri, where at the East Glenn Movie Theater was the location for preceding bootleg Cams. The Association felt that the bootleggers would appear at the “Dark Knight” opening weekend, and so they apparently did: Robert L. Henderson instantly drew the suspicions of investigators after he entered the movie theater wearing (in July) a heavy winter coat.
The investigators confronted Henderson later, seized his video camera and notified the police. There also were “Hell Boy 2” recording and part of “The Chronicles of Narnia – Prince Caspian” recording on his camera. Afterwords the police found 1,240 contraband DVDs during a search of his house.
Just two months prior to Henderson’s sentencing, 42-year-old Gilberto Sanchez from the Bronx was arrested and accused of uploading “X-Men Origins: Wolverine” unfinished workprint copy to Megaupload.

|This fine seems more reasonable to me than the one that Joel Tenenbaum is being asked to pay for his music files. This guy f'ed himself by having the 1240 bootleg copies. I'm sure things would of been a little easier for him if he had just been sharing the files rather than selling them for profit. He was Stupid and Greedy which is why he got caught and sentenced. I guess he would of only made like 5-10 grand selling his bootlegs but the fine should be inflated a bit. I don't really have too much sympathy for his case. That would be total different if his purpose was not for profit. That makes me question the original origins of alot of files on this site and what percentage of them come about first for profit. I've know of people in my area that sell bootleg movies out of there backpacks. Never saw how they made any real money in it unless they went mass production with teams of people selling there product. Which is the case in some areas but not in Grandview MO with a population of about 25,000. I'm in the dark :) THANKS again Sam!|

And @runswithbulls: No sympathy because his ultimate goal was a lil bit of profit? Some (perhaps even myself), download torrents and then burn them to DVD and sell them. I sell mostly to friends, who don't have the means/know-how to use Bittorrent. Have to charge something for those blank DVDs, it's not like they're free. Although, I will agree that 1,240 copies of one flick may be a bit too much, but who really cares. If you ask me, the only real crime here is that the MPAA has the ability to charge us $19.95 a copy for anything. Especially fining him $19.95 per disc (disc that they can't actually prove would have ever been sold in the first place). As ZOR4N put it: "they forget that we are many, many more than them." Besides, the guy turned over the camera and they got the discs. What more can they really want. If you tried to take a camcorder from me while leaving a theater, you have way more to worry about besides alleged "infringement", like the @ss-whuppin' you're gonna catch if you try to stop me from leaving with my camera. Cuz that's how a real pirate rolls. AAARRRRRRRR!!!!!!|

|@phoenixcrash, your a real friend for selling copies to your friends. You're the exact opposite of what P2P is all about. I make all my friends and relatives copies of any movie they want as long as they provide me with blanks. I have also set 3 of them up with everything they need to download as safe as they can. Went to their houses and everything. It would be more admirable if you just taught them what you know....like someone taught you.|

Don't see anything wrong with this I do the same and I have setup a few computers to download for a few friends that want to do it, but some people don't want to go thru the hassle so as he said somebody has to pay for the DVD's
|i sell to friends,family,co-workers.. nuttin wrong with that. they 5 dollars for a movie that they wouldve spent over 50 dollars and thats just the tickets..|

|There's a big difference between your friends buying your DVD's than friends paying $3-$5 a pop for a movie. I have heard of some in my area charging $5 for screeners that he burnt. That's fn' pathetic and a disgrace IMO.|

there nothing wrong about charging 5 bucks for a disk filled with avi's, not when your putting in your time,bandwidth,disks,cases and ink all it does is cover your costs, u dont make any money if anything its still at a loss. it is all still about sharing but with your computer illiterate friends that don't have the knowledge or the means to get them.its only wrong when you are making a profit, $3-$5 a disk yeh cool, $10-$15 a disk your ripping off ya mates lol.
Oh and when it comes to people saying wah wah wah support the makers of he movies well i can say is they make plenty, they should get paid a lot lot less than they do!
dont get me wrong i enjoy a good movie and i think it takes a lot of talent to act but i cant name one movie where i think an actor has truly earnt there 1-10 plus million dollars.think about it, that's more than a 10-50 times the amount that a surgeon that could save your family's life gets paid in a year im sorry i just dont feel sympathetic

|Runs with Bulls... The profit for that can be HUGE. I know of a fellow personally. Lives in a town of about 5,000. He sat up at a flea market in a neighboring town of about 15,000 pop. He was knocking down around $3,000 a week. He bought a lot of his supplies from us. We did his printing. I know how many of each item he bought weekly for year. Then they got him with over 700 DVDs.. the funny thing.. They fined him $100.00 and court cost.... I saw it happen. I had to be in court for a speeding ticket|

I stop buying Pirated DVDs since I discovered Torrents and ET. Why buy when you can download. Yes to file sharing.

I have NEVER received money for anything I have downloaded, and I would say out of all the copies I have made I probably bought atleast a 100 pack of dvd's that I am in the red for. Now I just say that I won't burn until they (family and friends) buy me more dvd blanks. ....and I'm proud of not charging.|

|I think the fee and sentence are ridiculous. Yes this man should be punished, but not like this. They might have just as well given this man a $2.000.000 fee. I mean: How long do you think it's gonna take him to pay off $24,738? Chances are he doesn't even earn that much money in a year! On the other hand I don't see why people bother recording movies in a theater. The quality is always awful, no matter how well you shoot and edit it. Neither do I understand how people can still make money off bootleg dvd's in a time like this, when almost everyone can just download them. Blu ray's would make more sence, since a lot of people can't burn those themselves (yet)|

|@darren1974, apparently you don't understand or I worded it wrong. I don't use dvd's for myself. I watch movies on my big screen via HDMI from my desktop. I play games on my wii via USB from my external HDD. The dvd's they buy are for themselves. They get them back with movies on them. Where I come from, friends and family do things to help each other. It's called Karma. What comes around, goes around. BTW, you can get 100 DVD-r here for about $16.50 which is around 10.7 pounds.|
|file sharing is about helping each other out, about trying and checking things out before you buy, or getting some things when you dont have the money to go buy them. The big argument in trying to keep file sharing going is that it doesn't effect the profits of the company. we get it for free and if we were willing to buy it anyway and it's good we still buy it. So making profit off it is giving them reason to charge us rediculous fines for these things. I have charged people for tech help but thats alot different. Spending 6 hours fixing someones computer that they messed up is not the same as charging someone for a movie that's not really yours anyways. This argument could go on for ever but File Sharing is about Sharing. Not called file selling. Might as well get the real dvd because it is better quality and has full disc image unlike most file sharing dvds.|

|What you get for free you should give back for free. Make people pay for the DVDR's but making money [ PROFIT ] from filesharing is for SCUM!!!! Sorry but that is LOW LIFE BS! profiting Pirates give file SHARING a bad name. People that do that is one big reason the LAW enforcement people and the groups like the RIAA/MPAA are so aggressive!|
Also, people should NOT risk their freedom shooting cams especially for people who do not appreciate the high risk and go out and make money off of movies that deserve that money. If people have the money to blow on movies that money should at least go to the people that worked on the film. I get way angry at pirate for money people!!! People need to have some ethics and draw the line somewhere! SCUM!!!! ROTTEN SCUM!!!! Let everyone enjoy the FREE films and stop making people pay for what should be SHARED!!!! Yep. I get for free I give for free. I got a job for money. I will agree the punishment was WAY too harsh. I suppose if you are a stupid criminal you're gonna get it in the ass eventually. It pays to rub a couple of brain cells together once in a while and manage to pull your head out of your ass long enough to accomplish a given mission without blow back. |File sharing is free. Sharing with complete strangers? Fine with me. But when I'd like to share a movie with some of my friends, it isn't always as simple as seeding. I live in a small town where there's only internet service inside city limits. Not only are most of my friends computer illiterate, only one of my friends even own a computer. So, it's not like I can just "give" them the .avi files, let alone show them how to use torrents. I have to convert the .avi file w/ AVS Video (1-1 and a half hour), drive 25 minutes to a store that even sells blank DVDs, burn it to disc, print the label, and finally sleeve it. I charge them $3/disc,5 for $15,or 10 for $25. I, for one, don't see a [email protected] thing wrong with that. Anybody willing to do that sh!t for free? Didn't think so. hottdogg feels me. And I never give 'em anything less than the DVDrip. Never. If that's not sharing, I don't know what is. I've never heard anyone complain about $3 a pop. I could let 'em pay $19.95 and wait for the dvd to actually release. The guy at the flea market charging $5 for a F#CKIN' CAM is the one that you should be ready to crucify here. Charge HIM with givin' pirates a bad name, then make his [email protected] walk the plank...|
