French controversial “graduated response” system meant to combat digital piracy saw its first victim while its validity is called into question by the government.
The “three-strikes” system works the following way: it starts with a complaint of a rights holder, and at first the alleged unauthorized file-sharer receives an e-mail notification, where they are asked to cease any activity involving unauthorized downloading. Secondly, a certified letter is sent to the owner of the broadband connection used in the infringing activities. Finally, the regime results in the actual suspension of the broadband connection of the subscriber suspected of sharing copyright material.
The first victim of the “three-strikes” system was cut off the Internet for two weeks and fined 600 euro. The individual was prevented from accessing any online service except for e-mail, VoIP and chat services, because those fall under the right to communicate. In the meantime, the offender had 10 days to appeal to the decision until the penalty is applied.
The industry observers point out that within the last few months the controversy around the “three-strikes” law has largely increased and its future is currently questionable. Back in May, a conclusion by a government commission was that the connection suspension should be removed and penalty and lower fines imposed instead.
After taking a close look at the present copyright legislation, the commission proposed for a copyright levy. In other words, Internet users would pay a small tax for each device used to play digital media. Such tax already exists in a number of other countries neighboring France.

You cant get profit by accusing individuals for copyrighted file sharing as most
people use proxy, vpn etc.and innocent people will pay!

|Just fine the violator the cost of the digital media content. Give them access to download the digital media content from an authorized distributor. Problem is solved. It is a win/win situation for all those involved. No internet service interruption or ridiculous fines that total many times higher than what the digital media would cost someone buying it from an authorized distributor.||
