The operator of 3 file-sharing portals was sentenced for more than 19 months in prison by a court in Valencia for linking to illegal digital material.
The admin of the popular websites estrenosonline.es, divxonline.info and seriesonlines.es seems to have bad luck, because the charges that led to his conviction pointed to making films and other copyright protected content available for streaming online without permission of the copyright holders.
If you remember, several years ago Spain seemed to be quite tolerant towards non-profit unauthorized file-sharing, but within the past year the country’s measures against Internet piracy were noticed to have toughened significantly. The case in question followed a complaint by EGEDA (an outfit that handles the rights of audiovisual producers). Apparently, the lobby group was satisfied with the court’s ruling against the admin – one year, seven months and 15 days in prison, plus 21 months of inactivity.
The organization claimed that the importance of the sentence lies in the idea that offering links to protected content actually constitutes an unauthorized act of public communication. In addition, the court ruling explained that responsibility isn’t exonerated once the accused individual is made aware of the illegal procedure, and it doesn’t matter whether the links were provided by the operator or by the third parties.

|Thats utter all out bulls&^#, offering a link to stuff that somebody else put online is no more a crime than crossing an empty street away from the crossing point. Spain has been known to have quite a comunity when it comes to shareing so i really dont think that this ruleing will have any impact at all.|
if only we could all send him a penny for when he gets out, i feel real bad for this guy.

I bet thouse will not be in jail that long if at all. Maybe this "EGEDA" also paid for "better" anti-piracy laws.

|Another idiotic ruling, this time in a criminal case. It's like putting the CEO of Xerox in jail for making copiers that someone can use to make copies of copyrighted materials such as books, pictures, artwork, etc. I would be shocked if the criminal sentence wasn't appealed.|
