Apple has finally won a court battle against its customers who claimed the tech giant was stealing their information. It was all about iPhonegate, where it turned out that Apple gizmos were phoning home data on user locations, which allowed tracking the location of Apple users. The company denied using the data.

The 4 plaintiffs insisted that the phone maker had violated its own privacy policy, as it had designed its iOS environment in order to transmit personal data to 3rd parties who gather and analyze such data without user consent or knowledge. The customers complained to suffer damages by paying too much for their mobile devices and losing storage space.

Nevertheless, US District Judge dismissed the case claiming that the plaintiffs had failed to prove they had relied on any Apple misrepresentations and that they had suffered at all. As you can see, the case was fairly weak – everyone knows that you have to pay too much for an iPhone just because you also receive the right to belong to the Cult of Apple.

The judge announced that plaintiffs failed to provide evidence that they saw one or more of the company’s alleged misrepresentations, actually relied on them and were harmed by it. If you don’t understand what this means it is your problem.

I have moved out of the UK, but it always amazes me that some people buy only Apple products like zombies. I suppose when your Apple device disagrees with connecting to any other manufacturers devices, you have to buy only Apple hardware just to have the same connectivity enjoyed by other manufacturer supporters across all devices.
It surprises me in this case that the fact that data was collected did not in itself represent an infringement of privacy. But like the Apple CentI-pad "South Park Ref' I guess the zombie mentality comes into play again when ticking/clicking the 'i have read the terms and conditions'.
Why won't it/they read!!!!!

I have seen many trolls on xda for eg but wow man you really are up there. trust me ive ran into people in forums working with HTC,Samsung and other tech sites hiding among devs to steal ideas or promote things i see sam as none of that ive been reading these articles for years now.Anyways to the task at hand apple cares only about figures consumers values are not extremely important due to the fact they flock like sheep to buy essentially the same device. but other countries are realizing it. android is growing much faster than ever and apple,nokia,microsoft etc are scrambling the the past few years to cripple basing most its arguments on design that was a given and patents that are barely implemented in any new tech. if you know what your saying you would realize how important samsung is and will continue to be in there technical development. samsung is not just a smartphone maker obviously they are samsung semi conductor as well also the leader in my book in nand flash future development, why is it you see LG and samsung actually competing to the point we benefit from newer innovative products not using tech you cant see eg 64 but chips and not really changing anything else but tell everyone you did for a huge price. remember apple stays untouchable because they are an american company in american courts who can beat a company that the us president pardons as an act of saving a us entity during times of economic crisis aka bs. so please stop i see no point to keep going apple needs to start from scratch and stop running the well we made the first phone whine fest realize its 2013 not 07 and things changed they are having a hard time because there innovative force mr jobs passed. im all for competition if the consumer benefits but when the company sees its consumers as a number than that's no good not to say they all don't but apple seems to think we are morons.

tonymengela avatarOk I have iphones and family has iphones, I recently switched over to Nokia windows phone and I like it for the most part. I honestly really not a fan of andriod, just my personal preference. I miss some things on my iphone as they like to make some things easy, but it did lack things. One thing that does have me pissed off with apple right now is the Imessage system, because I used apple I am no longer getting text messages from people with Iphones. because apple wants me to pay them $19 for technical support to simply take my number out of the I message system. I am seriously thinking of starting a class action lawsuit! I will be talking to my service provider again today on why is it apple can hold my number that I pay for ransom. Maybe start a suite against them as well.

First link isn't pro Samsung at all. It's the original story about the very trhing you are arguing about. Samsung have every right to defend themselves and appeal the case.

Good idea there tobeannounced (join intel). If Apple had a bit more freedom as Windows based devices with almost everything such as software/games etc, I may consider buying one Apple's laptops. Until then, I refuse to buy anything Apple produce as I have no need for a device which is limited to basically nothing I would ever have a NEED for.

Embolism avatarA very good article and links in response SaM,too everyone else who has not read their operating systems terms and conditions,Apple owns the software and as with windows O/S can do as they like with it no matter how much you pay for it,which means they may track you,share your data or in windows case hack you and drop any payloads on you they wish to now or in the future add to the o/s or change it in anyway they see fit.If you do not believe me use the magic search engine and check out Windoze hacking of 3 million O/S without the users knowledge or consent supposedly slipping them an anti-virus payload to prevent a rather nasty virus from spreading (never did prevent or stop the virus BTW)At the end of the day you all pay to use apple and MS but neither own it nor have any rights in doing anything other than using it and being shystered out of large money for a 20 pence disk its written on.If you read the TOS on apple you will also find that despite their so-called secure encryption any messages sent through apple may find their way to the NSA and or authorities at the discretion of Apple if such contains any illegal content(without need of a warrant or court order) so do not think you are safe asking your local dealer to drop you a baggie as you will then find the authorities being sent round to your pad and getting a shake down after they have located you and all your associates (for example).If after pressing F8 and agreeing to either TOS you want to complain about the O/S unless you can prove that their spying has cost you substantial amounts of money in lost revenue any court in the world will find it a vexatious waste of its time and kick the case out as above,smart people would`nt use it if they had read the fine print to start with. Embolism avatarIt might interest some with MS operating systems on their phones of another similar case I was presented with on software tips and tricks forum whereby despite having his phones GPS turned off one user was having his location broadcast and could not stop it.After further investigation I found that it was an inbuilt tracking function of the operating system that logged his coming and goings despite his having his GPS ticked as off and he could not access the .xml file or delete it to prevent such logging of his comings and goings,Bill Gates strikes again.
