MegaUpload founder suffered a significant court defeat from the NZ government and can now be extradited to face a trial in a US court.The court in New Zealand decided that the search warrant used in the Dotcom’s arrest on US online piracy charges was legitimate.

Apparently, the decision will benefit American prosecutors who claim that MegaUpload website made damages to movie studios and record companies of over $500 million, before generating over $175 million in criminal proceeds by allowing users store and share copyrighted content, like films and TV shows.

If Kim Dotcom is extradited to the United States, the ensuing copyright case will surely set a precedent for Internet liability legislation. In case Dotcom wins, entertainment industry will have to rethink distribution methods they use on the Internet.

According to the previous high court ruling, the search warrants were vague and enabled the authorities to seize stuff irrelevant to the charges against MegaUpload founder. However, the appeals court decided the warrants were adequately worded and shouldn’t have caused any misunderstanding. The court claimed the warrant clearly stated what the police could take.

It didn’t go all the American government’s way – the appeals court upheld a previous ruling that the prosecutors hadn’t been authorized to send clones of seized electronic evidence to the US. In other words, the New Zealand government could be sued by Kim Dotcom for its role in the raid in his NZ mansion.

Nevertheless, Dotcom may find it difficult to challenge evidence at his extradition hearing scheduled for July 2014. A Supreme Court decision is pending on whether American prosecutors must disclose evidence to be used in the court hearing. Both the defendant and the plaintiffs claimed they could also appeal to the Supreme Court to reverse the appeal court decision.

No avatarThis is such a bullshit ruling in a completely bullshit case. MegaUpload is no more a "criminal enterprise" than is Ford Motors for manufacturing cars that are used in crimes or that are driven by people that run someone over. It's time that some rational court in the USA puts an end to this ridiculous charade. The DMCA provides a "safe harbor" for hosting sites that are notified of copyright violations. No one is claiming that MegaUpload put copyrighted material up itself, as compared to simply providing a platform for others to put any time of material up, copyrighted or family pictures. That the US Government is acting as a shill for the entertainment industry is simply disgusting, especially when there are "real" criminals out there who actually kill people. But I guess that its much easier for law enforcement to hassle file-sharers than chase down armed murderers. This concludes my rant for today.

No avatarHow can you cry for KDC? We live in a age of knowledge you know piracy when you see it. Megaupload and a whole lot more are basically piracy enterprises. To sugarcoat it anyway else is just disingenuous and is one of the reasons that when the laws change one day it will come down harder than sopa or pipa. KDC and the likes try to say the believe in freedom and such and if that were true then why were they not NON PROFITS! If your a crook be a man and deal with it. Its the cost of doing business. My company has been a content producer the last 15 years. I have found my content all over the web. Most have taken our content down when we send notices and some tough guys have not. Hey they charge people to look at my content and many others so they are running a enterprise from the stuff i pay for. When we sue then they cry we are stepping on their rights of freedom! Thats BS i am just going after a business that makes MONEY off of my back! If you make no money from my works and take it down, i am pissed but i dont go after you .Mega made mega bucks and that why this will be a big case. If the Gov wins then the industry will change since anyone making money on piracy is now a fat sitting duck, if mega wins, then i will switch sides since it will make no sense for me to pay for content any longer when i can just rob thy neighbors catalogs and make money that way.

We have stuff in place for our prptection, fair enough dotcom can whinge as much as he wants that he is legit and we all know thats a croc of sh*t right. but with DMCA he and every other site on this planet that posts questionable items by the owner/uploader is Covered. these wa*kers who go after sites should lean on the DMCA for not doing their work! and leave the sites alone.. He has to be formally charged by a grand jury and to this date has not..
THAT is why he is still where he is; the laws would have to be changed.

Yes there is a lot of content out there that is no that great but that is not the content that is heavily pirated. There is also alot crappy Tv's , shoes, clothes and food should that be free? Should you just be able to walk in anywhere you want and take something because you feel that it is not quality. Most people think the piracy problem is not real since it is not a physical object, they don't see it, feel it or touch out it. They just press a button and think I deserve everything and earn nothing. Watch, when digital currency becomes more of a standard is when there will be big changes, when average have their own money invested in something, like digital currency or artistic content and it gets ripped off, then they will feel the outrage.
