Content industries have joined forces to freeze the assets of the former MegaUpload owner, but it seems that they might have to come up with a deposit first. Attorneys of 4 music industry companies and 6 Hollywood film studios applied to the High Court in Auckland seeking to have Kim Dotcom’s assets frozen.
The plaintiffs claim that Kim Dotcom encouraged and profited from massive copyright violation on the Internet, and want his assets to remain frozen while their lawsuit is under way. It is clear that they want to deprive Kim of the possibility to afford expensive legal aid in the United States. The companies that submitted this claim include 20th Century Fox, Paramount, Disney, Universal, Columbia Pictures, Warner Brothers, Sony Music, Capitol Records, Warner Music and UMG Recordings.
Dotcom and his family have had their New Zealand assets frozen already, and the attorneys who appeared for the movie industry said there was no evidence of any suffering or loss to Kim Dotcom. However, lawyers appearing for Dotcom and his family claimed that the Dotcoms were prepared to maintain the current freeze only if the plaintiffs offered security first.
Kim’s attorney explained that the content industries should put up $NZ250,000 for Kim Dotcom and a further $NZ250,000 for his wife first. The court agreed with him and decided that the amount requested was “peanuts” for such wealthy companies and said that Dotcom and his wife could suffer damages by having their capital frozen. As a result, the judge asked the parties to negotiate the conditions of the freeze. In case the attorneys fail to sort it out themselves, they will have to go back in court later in June. A few months ago, an application to extend restraining orders on assets of the MegaUpload founder, including cars, jewelry and other property, which have been in place since Dotcom’s arrest more than two years ago, was declined. Nevertheless, the plaintiffs, on behalf of the American government, appealed against the decision to let Kim get his assets back.
That next hearing on Dotcom’s case is scheduled for the end of July, and the lawyers for the movie and music studios want to have their application to have the assets frozen to be heard beforehand.

|Has Kim Dotcom ever spoken to any of you and told you it's a good idea to download copyright material? How has he encouraged anyone? He would have to personally encourage you not just provide a service, otherwise every ISP in the world would be guilty and have to have their assets frozen for Providing a service that can be used for copyright violations. So would every computer manufacturer, radio, VCR, DVD, TAPE RECORDER, SMART PHONE, Manufacturer etc etc etc. Even libraries, software developers, copy machines, printers manufacturers etc should all have there assets frozen for encouraging copyright violations, by providing the means to do so.|
