The government of the United States is celebrating victory in its civil forfeiture case against the long defunct cyberlocker MegaUpload and its founder Kim Dotcom. The US government received Dotcom's bank accounts, cars, art and other property worth dozens of millions of dollars. Of course, Dotcom is going to appeal the ruling at a higher court.


Three years ago, the US and New Zealand authorities seized millions of dollars in cash and other property from Kim Dotcom during the raid on MegaUpload, saying that all of it was obtained through copyright and money laundering crimes. Later, the American government started a separate civil action in an attempt to forfeit the bank accounts, cars and other property of Kim Dotcom.

The court recently ordered a default judgment in favor of the American government, which means that the contested assets (worth $67 million) now belong to the United States. It is known that over a dozen Hong Kong and New Zealand bank accounts have now been forfeited, including some of the property purchased through them. Apparently, those accounts processed funds received through MegaUpload’s activities.

In response, MegaUpload founder refuted the claims as “Hollywood nonsense” and insisted that MegaUpload was operating legally. Despite this ruling being a huge blow, it also opens up the possibility to Dotcom to bring the case to a higher court, while all previous rulings were designed in such a way that an appeal was impossible.

It should be noted that the recent court ruling is the first major victory of the United States against MegaUpload thus far. At the same time, Kim Dotcom and his colleagues are still waiting to hear whether they will be sent to the United States to stand trial.

Everyone knew there was no way for him to win this from the get-go, the MPAA/RIAA and US-Govt. Saw this as both a pay-day and a detterant.

Why do the citizens of the US put up with this?

neato avatarUS citizens put up with it because is just too much trouble to start a revolution, too much trouble to vote for the correct candidates, if is not affecting me at the moment who cares type attitude, we just want to seat around the BBQ and burn some meat and drink beer while the Government do as they please, that is why.

No avatarIf I remember correctly, one must demonstrate some financial loss to successfully sue. Where is the US gov't claiming they lost money from Megaupload? We all know the movie & music companies - like all big corporations - are good at getting out of substantial portions of their taxes, so how does the gov't lose tax monies it likely wouldn't have received in the first place? I can see them seizing the assets in a successful criminal prosecution but in a civil suit???

Crash1 avatarLet me guess ... an AMERICAN court, with an AMERICAN judge, paid by AMERICAN corporations handed down this DEFAULT judgement, against a FOREIGN citizen, NOT IN THE COUNTRY? And his extradition hearing is still ongoing, so a DEFAULT judgement was guaranteed, because for him to contest the charges he has to appear IN PERSON, IN THE COURTROOM, but if he enters the USA to contest those charges he gets arrested on trumped-up charges.

If another country tried to do this to an AMERICAN citizen they'd all scream bloody murder and deny everything.

Embolism avatarstill not everyone should be expected to be as loyal as the owner of a secure mailing site used by 100,000 `s who instead of giving up his clients data shutdown as was the case with Ed Snowdens,but if kim had any code of conduct ,honour,decency or even good sense he would not have voluntarily given up ninjavideo to the Feds but rather fallen on his laurels and not his sword and closed up shop,saving him and his clients,keeping their trust and patronage in future endeavours.

The only way to win a DEFAULT judgement is by the opposition not showing up to defend itself. DotCom simply didn't refute the charges.
Most likely because he didn't know he was being sued in the first place. In several states....posting a court summons in City Hall or the local library is considered suitable "Service".

Embolism avatarKim knew this day would come 3 years ago and has no doubt got a sizeable nest egg diverted through off shore accounts and written off as diversification and expansion,charitable contributions and development funds,but judgement in Absentia is quite common as a practice for felons who skip bail or fail to appear for judgement and given that the whole world and their dog saw him captured and that the case has been covered by the media globally it is now demonstrated that they win in the end,at least to casual observers,what they have not charged him for yet is the enterprises he has started up since his arrest 3 years ago and we await to see further developments,a good article.
