Kevin Bollaert, 28, who operated a so-called “revenge porn” online service and then extorted cash from victims to remove nude images and personal data, was recently sentenced to 18 years in state prison. The individual from San Diego was convicted of 21 counts of identity theft plus 6 counts of extortion for operating a number of online services that capitalized on the worldwide web as a place for public shaming.

Kevin Bollaert created a website called ugotposted.com, where jilted lovers and hackers could publish nude photos and personal data of people, including names, addresses and social media details, without their consent, while remaining anonymous. Over 10,000 images, mainly of women, were uploaded to the website between December 2012 and September 2013. When victims of such behavior sought to have the embarrassing images taken down, they were directed to other website operated by Bollaert – changemyreputation.com – where they were charged up to $350 to remove the images.

The court sentenced Kevin Bollaert to as long as 18 years because the compromising images cost many people jobs, damaged relationships and even attempted suicide. In the meantime, the individual earned about $900 per month in advertising revenue from his site and, of course, collected quite much from the victims (around $30,000).

In attempt to defend his client, Bollaert’s lawyer was trying to insist at the court that although his business was indeed gross and offensive, Kevin Bollaert didn’t break any law, because he was not posting any pictures himself – instead, he allowed other Internet users to upload the explicit content.

No avatarbullshit sentence but can't expect anything else from the incarceration nation. trumped up charges and wild interpretations. who needs consent for a picture you own? it's bullshit, but the law is meant to protect sluts so it doesn't have to line up with the rest of societal reasoning. here's a tip, don't let someone take pictures of your dumbass nude. women are generally considered a whole lot stupider then men so laws like this get passed.

No avatarIt seem a civil matter rather than a criminal one. Lawsuits against those who published on the site, and a civil action to force removal of material from the site. The law is unclear about the webhost demanding a fee to remove material, but the posted material is not technically the property of the victim.There is no crime in the legal sense, but this issue must be addressed. Those who posted damaging photos should be the ones who face charges. If I sell buckets of vomit and suggest uses for it, do I get arrested when you pour that bucket over your boss's head?

Crash1 avatar@Chariot ... 'No crime in the legal sense'? He was charged for EXTORTION! For using one site HE OWNS to CHARGE victims to remove illegal pictures from ANOTHER SITE HE OWNS. THAT'S extortion no matter which way you look at it. BTW, the law states that any picture containing your likeness can not be shown publicly WITHOUT YOUR CONSENT (that's why all models must sign a release for every photo-shoot), and by hosting the pictures on HIS PUBLIC WEBSITE, HE is the one breaking this law, not the poster, since he failed to request copies of the releases (if any) before showing the images on his site.
The fact that by operating those sites he caused extreme hardship to a lot of people, PROFITED from that hardship, AND SHOWED NO REMORSE, is what caused the extended sentence.

I say good riddance to bad rubbish!

No avatarIdentity theft, to sum it up, is using personal information to gain access to, or entry into, any property, intellectual or real,or the use of same, for any purpose by using information that is representing another person or entity without permission of same. I don't read that in this article.

The site is disgusting, and charging for removal is heinous, but not illegal. If I make a video of you and show it on some popular site, what or whom do you choose to condemn. We may need laws demanding I'd verified for any posts, so those who publish can be made responsible for libelous or criminal action. Since I hate laws in general, and rules, and all that, as their very existence shows us we can't just be good and fair to each other, I just wish this stuff didn't exist.

Now, you could argue that - if he hadn't extorted the victims, and made quite a tidy profit from them mind you - that he isn't to blame, the uploaders are. You could argue that, but you'd be ignoring some key points. He was the one responsible for what was allowed on his site. He hosted the material, and allowed it to be posted. Think of it like this. Imagine someone uploads child pornography to this site. Would you expect Ozzi or any of the mods/admins to remove it post haste, or should it be allowed to stay on the site?

you could even have a drop down menu with how urgent your case is with the most fast option set at a dollar amount.

its funny because if he planned it better and tried to make more money out of it, it wouldnt have seemed like extortion but a well oiled business model and he most likely wouldnt have been sentenced at all.

the law is in place to protect the weak and gullible. that includes weak men, gays and women.

Crash1 avatar@Chariot ... It's NOT illegal to SEND a picture of a person ANYWHERE, but it IS illegal to show that image PUBLICLY. I could legally send a photo taken at a nude beach through the mail, but if the person who receives it posts that photo on a bulletin board, nails it to a lamp post, or allows it in any way to be PUBLICLY viewed, he's in deep sh!t (unless he has a release from EVERY recognisable person in the image).

Therefore POSTING the image to a website is not illegal (though it IS immoral), but if the site owner ALLOWS the image to be viewed PUBLICLY, without a model's release, he's going to jail. (which he IS!)

@Livevil ... You're wrong there ... ANY WAY you look at it, he'd STILL be sentenced, because simply by HOSTING the images WITHOUT A VALID MODELS RELEASE, he was breaking the law. Therefore he would have to IMMEDIATELY delete ANY IMAGES requested, by ANYONE, apon receiving a takedown request (unless he can provide a VALID models release for those images ... ie legal authority to publicly show the pictures). In other words, HE has to provide proof that he can legally show the pics ... the person requesting the takedown doesn't have to prove ANYTHING, because any form of ID transferred over the Internet could be used to facilitate Identity Theft.

Similar to DMCA takedown notices for copyrighted movies/music. Any copyrighted item must be taken down on request unless a copyright release form is held. It doesn't even have to be the copyright holder who makes the request, but if they request a takedown of LEGALLY HOSTED CONTENT, then THEY can get in legal difficulties. (Like when Mega got an ILLEGAL DMCA takedown notice for Kim Dot Com's Music CD and Music Video's ... Mega was OWNED by K.D.C at that time, and he'd provided a SIGNED RELEASE TO THE SITE to host his content there, therefore the copyright troll entity that sent takedown request was presented a legal cease and desist order from MEGA, and any further illegal requests from them COULD get them fined or jailed.)

No avatarI know that there will be a few of you that think that I am trolling or flaming, but I am honestly just voicing a reasonable opinion. More than a few of you will most likely agree with me.
The website that this guy was running was a revenge site, right? Well, I can think of only on type of person that would be blasted on a revenge site, and that would be a cheater. People just don't wake up one day and think, “I'm going to post pictures of my loving spouse, or significant other, on a trashy vengeance based website today!” This just doesn't happen. It is only when someone feels like they have been done wrong, or want someone to know that their lover is doing wrong, that someone would seek retaliation.
So, the site in question was full of pictures sent either by the estranged partner, or by the cheating partner's new sexual toy. It really doesn't matter if the cheater is a male or female, though this article says there are more women on these sites than men. A cheater is a cheater, and if they aren't proud enough of their behavior to have everyone aware of it, maybe they should reevaluate their lifestyle and choices.
This article states that this site cost people money, jobs, relationships, and almost lives. If someone thinks their behavior is unethical or ridiculous, then it should be worth a few hundred dollars, at least, to avoid that scorn. If a relationship is based on a lie, there wasn't much to lose there anyway. If someone is going for a job where integrity and moral fortitude is a requirement, then these people working under false pretenses would be paradoxical to say the least. If someone has conscience enough to know who they are, why it's wrong, and how little they mean to humanity, the only thing that went wrong is that they didn't succeed. There is no real crime here.
At least two questions remain... First, who is less moral in this situation, the person who cheats on the one who loves them, or the person that exposes the cheater as the horrible person that they are? Second, why have there been laws imposed to protect the supremely immoral? These laws kind of indicate that a large number of people are too weak, dimwitted, mentally ill, or gullible not to do the things they are ashamed of doing. In the old days, cheaters were publicly ridiculed and killed. It was called justice, not extortion, when these individuals were forced to pay with their lives. People who actually think this guy is deserving of punishment, while those that he has helped expose should be free to repeat what they are doing, need to look at their own moral compass.
If his own mother or sister were cheating, he would most likely charge them money to take their pictures down, too. He would be right to do so. None of us on this planet are perfect, but this guy deserves a commendation, not incarceration.

No avatar@Breathless - Just have to point it out... A "jilted lover" is the innocent victim of a callous cheater. A "jilted lover" is the woman or man who finds out that the person that they devoted a lifetime to has been unfaithful to them. Google it.
@ Lenna - The above discussed website is not an amateur porn site. This was a site created for jilted lovers, as Breathless pointed out, to get REVENGE upon those that have done them wrong. If your neighbor accidentally ran over your dog, chances are that you are not going to have sexually explicit photos of them. Even if you did, you would be less likely to post them on a vengeance site. Even a hacker would be unlikely to have explicit photographs of someone to put online. It is the jilted lover, or the new "player" that would possess such material and be inclined to post it. So, there is no need for you to call anyone stupid. Yes, there may be some innocent victims on those pages, but I would bet that most of the pictures are genuine cheaters, and these sites pretty well MUST be for exposing cheaters. Most people don't feel jilted if a relationship just runs its course.

Jilted lover: A person that has been dumped somewhat randomly. Often the person starts drama with whomever dumped him/her and tries to play the victim when actually the other person is and tries to play a heartbreaker at the same time so it gives it away that they're still hurt.

I actually mentioned gooGling... I know that it is a stretch of the imagination to think that in today's society that an abrupt or unfeeling end to a relationship could possibly be applied to infidelity... See, I did google it before I mentioned it, and just thought that you might be intelligent enough to realize that what I was saying could be true. If you really read what I wrote, instead of just glossing over the things that you wanted to attack, you will find that I am not wrong on all counts. I'm pretty sure that I mentioned that there may have been innocent victims on his site, as well. I never claimed to have all of the answers, I never hailed this man as anything but a man, I merely stated that it was a reasonable opinion, and I NEVER told you that you were wrong for having your opinion. But I am sure that any opinion that differs from yours could never be right or have any merit, because you have the time to look up the narrowest definitions available, the uncanny ability to apply them to only what you want to prove your point, and the open-mindedness of a four year old in time-out.

Anyway, to crash, extortion, blackmail, copyright infringement, intellectual property theft, and suchlike rude behavior is considered criminal. All this other stuff is not. The victims of public posts that are made without consent can make civil redress. The website could have liability as well. If there was conspiracy between those who posted and the site owner to extort or demand money to remove the damaging post, ah, now you have criminal intent. If money was collected and shared, you have a crime. We really beating this dead horse now!
