It’s been more than three years after the popular file-sharing service MegaUpload was raided by the US authorities and over 1,100 servers were seized across the country. However, 32 more servers were also locked down in Canada, and their contents remain a mystery. Now the American government makes another try to get its hands on this hardware.
Back in January 2012, the US law enforcement authorities seized more than 1,100 servers at Carpathia’s hosting facility in the country – today all of them remain idle in a Virginia storage facility. Now the Canadian servers are under threat. Three years ago, a judge in Canada issued a warrant to seize the 32 MegaUpload servers, after which the American government asked Canada to hand the hardware over.
A year later, Kim Dotcom and his legal team protested the handing over of the hardware to American authorities, arguing that the Canadian servers contained information irrelevant to the case. The defunct file-sharing service agreed to allow an independent forensic examiner to determine their contents before such handover, and the Canadian court sided with Dotcom. Today the case reappeared before a Canadian court, with the US government accepting Dotcom’s offer and suggesting to appoint an independent group of US forensic examiners to find out which data is relevant to the case.
However, now MegaUpload is afraid that that once back in the United States, the examiners might disclose non-relevant information because any non-disclosing ruling in Canada would not be enforceable in the United States. Therefore, MegaUpload suggests to hire an independent Canada-based investigator.
