While in most of countries fair use is not welcomed and causes a lot of arguments among various copyright protection bodies, the United States prove the profitability of fair dealings, showing incredible results for the state economy. In 2007 fair use has brought about $4.7 trillion into the state treasury.
Fair use has its own enemies like recording labels, media entertainment companies, film industry reps, etc. A lot of measures like anti-circumvention law and DRM protection were established to fight it. These measures somehow impact the effect of fair use but this impact is not significant compared with benefits. The US economy still profits a lot.
The research held by Computer & Communications Industry Association, has presented the actual information about the economic contribution of industries relying on fair use. The research results claim that compared with 2006, the revenue increased more than 5% in 2007. Additionally, fair use companies provided with 100 000 new jobs. The volume of the US export by fair use industries was increased to $281 billion that is 12$ more than in 2006.
All in all, 2007 has brought about $4.7 trillion in revenue and $2.2 trillion in value added. Since 2002 17 million people was employed in fair use economy sector, whose total payroll reached $1.2 trillion.
Among fair use institutions are educational establishments, internet services like web hosting providers, search engines, software development companies, digital device producers, etc.
The study says: “The protection provided by fair use and other exceptions in copyright law is a major reason of such economic success. The economic growth in fair use economy will be continued, the US economy will be more and more dependable from information industries”.
Computer & Communications Industry Association, that has conducted this research, includes Google, Microsoft, Yahoo, Oracle, eBay, AMD and lots of other powerful companies. The survey was intended to show that copyright “freedom” even in a very limited sense like fair use, can bring lots of profit on a national scale.
According to the US law, fair use is not the copyright infringement. It allows the limited usage of intellectual property without permission from the rights owner in the list of areas like research, teaching, criticism, etc. All the cases where fair use can be applied are strictly described in the US laws.
