The tech giant is facing a $5 million lawsuit over its settings in the latest version of iOS that uses mobile data when there are problems with the wireless network. This feature was named “Wi-Fi assist”. In general, the system senses when Wi-Fi connectivity is weak and instead routes the device over mobile data.
For some reason, the feature is enabled by default in iOS 9, and it isn’t easy to understand when it is active (in fact, the only explicit sign is that the Wi-Fi logo on the phone’s screen becomes greyed out). This is why users have reported accidentally running up large bills for mobile data usage because they believed they were on their home Wi-Fi.
Recently, a class-action lawsuit was launched by a couple of users who received an overage bill. The customers charge Apple with negligent misrepresentation and with breaching Unfair Competition Law and False Advertising Law, and want the company to reimburse affected users, alleging that the total potential damages could exceed $5 million, taking into account that Wi-Fi Assist is enabled on every iOS 9 device.
Apple was quick to update its website to clarify that users “may use more cellular data” with Wi-Fi Assist on, while pointing out that this should only be a small percentage higher than previous usage. However, the plaintiffs do not agree that this is enough, pointing out that average consumers use their iPhones and iPads for streaming content, which can use significant data and thus lead to huge mobile data bills.
It should be noted that Apple is not the first company shipping such feature to its customers. For example, Samsung, HTC and LG also have equivalent features on their own phones, but none of the Android manufacturers have faced a similar lawsuit. Yet.

"but none of the Android manufacturers have faced a similar lawsuit. Yet."
Probably because, in Android devices, features like that are "Opt-In", NOT 'Enabled by Default' as they are in Apple devices. (at least it has been on all the Android phones and Tablets I've ever owned.)
This is just one MORE reason I would never own an Apple device, even if you GAVE it to me!
Can remember seeing this people getting massive bills because of it
Well Apple stuff looks ok, nice design & whatnot, but iOS is a piece of c r a p as well as MAC OS, total waste for idiots!
Plus you can buy amazingly great Dell which will worth cheaper & will be more powerful than Mac, same goes for smartphones, buy like Nexus 6 or ASUS Phone!
LOL at your comment Matey2015 Jealousy gets you nowhere Matey 99% of people who say Macs are waste of time BECAUSE you can't afford one.
Not at all man, it's just a piece of shit!
Being a poor piece of shit myself I can't even afford a simple smartphone bro, but have I had a lot of money I'd simply buy Dell & Nexus coz MAC & iOS are total shit I simply don't like it!

Add in the fact that the Apple iPad is the ONLY tablet currently available with NO EXPANSION CAPABILITY (SD card slot or USB port) and you start wondering why people even buy them. The ONLY way to put music or anything ELSE on them is to DOWNLOAD it from THEIR store.
Compare that to Samsung or Microsoft (or any OTHER tablets out there) that have either or BOTH an SD card slot and/or a USB slot (most have both) where you can put on your OWN music and movies (that you've ALREADY paid for once) and you have to wonder. These tablets also use a modified form of Windows as the OS, which people are already familiar with (and which is a true MULTITASKING OS, you can run ACTIVE tasks in the BACKGROUND (ie download a movie in the background while you're playing a game, etc). Whereas the versions of iOS I've used (haven't used iOS 8 or 9) were all UNI-tasking ... only the CURRENTLY SELECTED app was active, and the moment you switch to another app the previous one froze until you switched back to it.
As for Macs, THEY can't be expanded either. Want to add another internal hard drive? FORGET IT! Want more RAM? MAYBE, but you'd have to take it back to the dealer and PAY THEM put it in, because your warranty is void the moment you open the case. (and if Mac's are so great, why do almost all COMPANIES run PC's with Windows? Because an Apple Mac is a PERSONAL computer for people with ZERO technical knowledge ... just plug it in and go.)
Compare that to a PC where you can have as many HDD's as you have Motherboard connectors for (6+ these days) and you'll see why most small/medium company servers are based on PC hardware instead of Macs. (and the REST have a datacenter, and datacenter hardware is different due to the computation and data throughput requirements.)
OK ... Rant is over ... until the next article about APPLE mobile devices anyway.

To all those slating Mac's I say this. When was the last time you PC crashed, when was the last time your PC was either targeted or got a virus or malware. In the last 12 months since I purchased my latest 27 inch iMac. The only time I have had to turn it off and restart was to install an update. It has NEVER crashed or locked up. As for the use of Mac's in companies, it depends on the type of company you are talking about. Your every day company requiring word processing and data entry may well prefer a PC. But when you start looking at companies using there computer for intensive graphics and media applications. They pretty much all prefer a Mac.

Mate of mine has been using a Mac for years to do his "On Hold" messaging service and to edit/create audio for his band. He had purchased a new Mac but after three months of persevering with the crap software he had a PC built to hand all his audio needs. He is now happy as a pig in mud. When Mac had their own chips they were great for Audio & Video now they are no better than a PC but you can get hardware add-on's to produce a fantastic machine.

LOL at #4 Yeah, i should be upset at not being able to afford an over priced status symbol like an imac, when i can build a better pc for at least half the price, if not cheaper. Yup, SOOOOOOOOO jealous and upset here
#9 I don't think so, I've look at both and the iMac is slightly cheaper… Take into mind that I'm looking that all-in-one, because that is what a iMac is; Computer+Monitor. So if we take equal (or as close to) parts. The Imac is cheap. So as for the iSO it is Solid! It restarts quick, no virus or malware in 9 year and you can leave it on for months straight if you wanted to. And last Windows OS I used was windows 8… WTF what that! At least the company I stand behind does create crap like windows ME, Vista and its new baby 8… And lets not forget the "Cow milking" 5 different versions of XP, 5 versions Vista, 6 versions of 7, 3 versions of 8, 3 versions of 8.1 (yeah, they made people pay for an upgrade…)
Mac… last 3 iSO FREE 1 version!

@9 and many others who r apple fanboy
1st the apple is not cheap
2nd u cannot make what do u want with it [customize]
3rd if in 9 years no virus/malware that's bcz no1 developed a virus/malware for this soft coz not worth the time to create it
4th the ppl buy apple just for the "name" after they realize they make a big mistake ppl turn back to the previous gadgets or pc or soft before start using apple products
5th this is not my opinion is a fact of course not every1 will agree what i wrote but it's clear like the sky
so now my point of view: how many apple users [WORLD WIDE] have a macbook, iphone or/and ipad and have access to the cloud and know how its work to download something ...
GL everyone and Happy Halloween !!!

Lol... OS wars.
Whatever overage charges users might have. It is still worthy of a lawsuit for the false advertising, negligent misrepresentation
While the response should have been to remove the automatic feature from the IOS 9. It did not.
Too bad all the families of those who committed suicide working for apple in China couldn't sue.

crApple sucks. the only thing it is good for is if you are a graphic designer, and that's because one of the best softwares are only made for crApple. for anything else it is a complete waste of money and freedom. I will never use apple stuff, not even for free. because if I get myself using something from apple I will feel like a retarded.

The solution for people who want the best of BOTH worlds (The customizable versatility of the PC and the graphics programs capability of the iOS) WITHOUT having to BUY both, then the solution is a Virtual Machine system, where (if your hardware is beefy enough) you can run BOTH iOS for the graphics software AND Windows 7/8.1/10 ... simultaneously. [You WILL need an unlocker program to enable installation of OS-X under VMWare Workstation]
(MY system has Win 8.1 x64 as standard, but I also have both a Win XP x86 VM [for older 16 bit software/games] and an OS-X VM for some Apple software that won't run under windows [a VM is much easier to use than an emulator]. To use this I have an 8 core AMD CPU, 32GB RAM [though only 16GB is ever actually needed unless you're running more than 3 VM's concurrently], and a 2TB Internal drive strictly for VM's and swap files. )
Most HOME users will run base Windows OS for the software and game compatibility (not many GAMES for the OS-X/Mac) then start up the OS-X VM for any business applications that require it (and shut it down when finished). This has only been possible since Intel started making CPU's for Apple ... it wasn't possible on the old Motorola processors as they used a completely different architecture.)
yur right ,, crapple is only good for graphic design ,, I'm rich and can afford any pc I want ,, and then sum ,, but I totally buy windowz based pc's ,, why ,, cause you can expand the memory on all devices,, and the softwares avail to get any task done is limitless,,, people who buy apple ,, do so to get people to think they r in sum upper class society ,,,cause they own a crapple phone,, this article proves they are junk ,, expensive junk at best,,, stick with the expandable memory and storage options ,, and limitless software and cost effective things and you will always be happy like me,,YAY!!
Put it this way. Apple computers are mostly for non-tech people.
There are many high performance Linux and Windows systems
that Apple can't even touch. Apple fans can't upgrade their
computers or phones.
