Theresa May has unveiled the provisions of the draft investigatory powers bill, saying that new surveillance powers will be granted to the police and security services. Such powers would allow them to access records tracking everyone’s use of the web without any judicial check.
The proposed legislation includes new powers that would require ISPs and phone companies to store “Internet connection records” for up to a year. At the same time, the police, security services or other bodies will not require a warrant to access the collected records. The only exception is that the local authorities will be banned from accessing online records.
In addition, the bill also introduces a “double-lock” on the ministerial approval of interception warrants, providing for a new panel of 7 judicial commissioners given a veto before they can come into force.
However, the disclosed details of the bill make clear that this new safeguard for the powers to spy on the content of your communication won’t apply in “urgent cases” where judicial approval is not possible. The proposed piece of legislation aims to provide an overhaul of the country’s surveillance laws, coming in the wake of Snowden’s revelations of the scale of secret mass surveillance. If passed, the law will replace the system of 3 separate commissioners with a senior judge as a single investigatory powers commissioner, which exists today in the United Kingdom.
Theresa May claimed that the introduction of the power of storing everyone’s online connection records (which is banned as too intrusive in the US and Europe) was just the “modern equivalent of an itemized phone bill”.
