A few days ago, an appeals court upheld the FCC’s net neutrality rules that require ISPs to treat all Internet traffic equally. The three-judge panel’s 2-1 decision was made in favor of consumer advocates, the regulator and the government who have campaigned to protect an open web for a while now.

At the same time, this decision is a major setback for the cable companies and other ISPs who oppose the rule-making. However, it is unlikely to be the last time the net neutrality rules are challenged, as both sides want the case to be escalated to the Supreme Court.

The net neutrality rules change the FCC’s classification of ISPs by treating such companies like a public utility and try to prevent companies providing Internet connections from privileging traffic. Internet activists have fought for the net neutrality rules for a long time before the FCC passed them in 2015. Prior to that, the regulator received more than 4 million comments.

Industry watchers believe that the case will almost certainly continue its way up through the legal system. The next step after the recent ruling will be to appeal to a panel of more than 3 judges. The plaintiffs have already acknowledged this fact, saying they have always expected this problem to be considered by the Supreme Court. The ISPs look forward to participating in that appeal.

Meanwhile, the FCC argued that the net neutrality rules are important for allowing customers to surf the Internet without a broadband provider favoring its own service over that of competitors. It should be noted that the FCC reclassified broadband after the US President publicly urged it to protect consumers by regulating Internet service as it does other public utilities.
