ISOHunt Gets Permanent Injunction in USAdded: Tuesday, May 25th, 2010

It has been a long ongoing fight against ISOHunt website in the United States and now the new court’s ruling was that ISOHunt has received a permanent injunction in the United States. Moreover, one of the reports says Gary Fung, the owner of the website, could face a jail time if he fails to comply.
The American courts were concerned that ISOHunt was not faring too well legally. They announced that on the case of a permanent injunction, they have considered the documents filed by the sides, as well as the arguments presented at the last hearing. As a result, they entered a Permanent Injunction against ISOHunt. The only notable line in the ruling was about the inability of the copyright holders to track and proceed against every single violating end-user.
There isn’t any news that copyright owners won’t ever be able to track each file-sharer out there, which means that if too many users do something, not everyone of them can face the consequences. What is more interesting is that it is an American ruling holding a Canadian site (also operated by a Canadian citizen) liable and somehow subject to American law!
As you might remember, ISOHunt issued a light version of the website in order to satisfy the previous court ruling. This decision had a comment on that too. The court decided that the “Lite” site has got all of the same features as the original one, including indexing and searching functions. The only difference was an interface for customers to operate. That meant that ISOHunt had not even ceased encouraging infringement.
Moreover, the Financial Post suggested the founder of ISOHunt could now face possible prison time in case he fails to comply with the injunction. That was not interesting anymore, but rather strange for the website which was filtering out American residents and was operating out of Canada by a Canadian citizen! How did it happen a US court could rule a prison time on a Canadian?
After this case, critics began to worry that American laws could now somehow apply to Canada and the US can always rich whoever they want in Canada. Actually, there is a similar case to recall – with Marc Emery, a Canadian, selling seeds in Canada. Unfortunately, the seeds found their way to US and the latter got infuriated. As they couldn’t reach him in Canada, they simply got him extradited to America and he faced a jail time. Although it’s doubtful that ISOHunt owner will face any prison time, the case makes others worry about their level of freedom.

|i used to use isohunt for my tv shows its just a matter of time now makes me worry about all the other sites i frequent of which this is my fave makes me sad oh well back to my downloads thanx sam for the article it was very informative made me think at 630 in the morning lol|

|Good luck, Harper doesn't have the parts to argue with the MPAA. He can't even explain why he fired a MP to the public and is refusing to allow the Auditor General to do a audit of the MP's performance's. He and his goons dont care about anything other than their pockets and the US is probably contributing to PM retirement fund somewhere.|
ENough rants on him, the Canadian citizen, running a site which is not illegal in Canada should have no reason to be held liable by a US court for US laws. He has not entered the US, its a tracker site, not a actual storage facility of illegal material so enough already.
Frigging spend more money making good movies and less on stupid lawsuits and the MPAA would probably come out ahead.
|This is quite upsetting,they are just taking one down after the other,it should make us all think about the future of file sharing,torrent provider sites,now about USA judges wanting to do whatever they want with citizens of other countries ,that should be fought by the country rulers in this specific case Canada,if USA goes forward with this Canada should defend their citizens rights with all their forces!!|

|I think it would be very hard for them to jail him unless he enters the US...And if he went to the Canadian court to get an ruling from them it would not take the US long to change that ruling.|

|you can probly get around that by using "Hide IP Easy" and route yourself from another country, the download is on this site and works very well, you can choose any country you what to have your IP from|
|I never ever really read the articles but this one couldn't help but catch my attention. Also ISOHUNT was my main torrent site and when it went to lite I came to ET which is the place I spend 3/4 of my computer time and is just a great site. But anyway I couldn't agree more with yitzhak007. Start by saying that Americans lost all their rights when the Patriot Act was passed giving the U.S. government the full power to basically do whatever they want. Noone can believe anything that is seen on the news for the news is owned and ran by the government. The government wants to own everything, or get a piece. While I am an American I cannot and will not say that I am a proud American for greed has taken over the souls that run not just the U.S., but many others if not all other countries too! I am and get so frustrated with the fact that for instance the Iraqi people prob think all Americans fell and think what the government is doing is right and that's just not the case. People need to stand up for their country that they believe in as the people and not let a bunch of greedy money hungry people who call themselves leaders take away our rights not as an American or Canadian or where ever, but our rights as a nation! Band together and stand up for what u believe in and say eNOUGH! I mean how many Rolls Royce's and beach houses along with money does one need? All this plus a whole bigger picture in my opinion is GREED! That's why I have to smoke weed! Because all the hatred and greed and killing over religious beliefs! Everyone has the right to believe in what ever the hell they want! Will the fighting ever stop? Or will every right as a human being get striped away as all the nations wage war and destroy the whole planet? Will miss ISOHUNT but bigger picture is to stand up and do what ever you can to voice your opinions on what could be yet another freedom speaking on another Freedom for people of the world to lose..... What a shame the human race is becoming!|

|Keep the articles coming Sam, I enjoy the reads. It sucks that Isohunt won't be available, but if it weren't for them going lite.. I would not of found this site, everything happens for a reason ;p|
