|Two years ago, Sony became a victim of a massive cyberattack. As a result, lots of data was stolen, including several movies, which immediately appeared online. Now Sony is sued by the owner of one of the titles, who claims that it failed in its obligation to protect the film from pirates.
Sony was hacked by a group named “Guardians of Peace” in November 2014, which resulted in lots of sensitive data leaking online, including emails sent between key Sony staff and several movies (Mr Turner, Still Alice, Fury, Annie and the unreleased movie To Write Love on Her Arms). Possibility Pictures, the owner of the latter title, now sues Sony Pictures, claiming that the company failed to meet contractual obligations which required it to protect the content from pirates.
Possibility Pictures claims that it was due to Sony’s negligence that the movie was leaked 4 months ahead of its official release, thus effectively destroying the audience demand for the movie. Besides, after the leak, Sony allegedly “lost all interest” in promoting and marketing To Write Love on Her Arms and paid no further distribution revenues to Possibility Pictures. As a result, Possibility claims that it suffered losses of almost $2.6m versus production costs.
The rights owner points at the section of its distribution agreement with Sony titled “Anti-Piracy Authorization”, which obliges Sony to protect the title in order to remove, disable or otherwise prevent unauthorized versions of the title being pirated online. However, Sony insisted during discussions with Possibility Pictures that it had “no obligation to take any anti-piracy measures whatsoever.”
