MegaUpload founder Kim Dotcom is going to seek a review of a federal court decision that again rejected his attempt to keep hold of millions of dollars in assets.

A 3-judge panel of the US court of appeals ruled that the entrepreneur could not recover his assets because he remains a fugitive while outside the United States, which disentitled him from using the resources to fight his case. However, Dotcom is ready to seek a review of the decision in front of the full bench and even petition the Supreme Court.

Kim Dotcom has been fighting extradition from New Zealand over charges of copyright infringement, racketeering and money laundering in the United States in connection with the MegaUpload file-sharing service that he set up in 2005. A New Zealand court ruled late last year that Dotcom could be extradited, but the entrepreneur appealed that decision and the hearing has been set for later in August.

In the court judgment, chief judge decided that Dotcom and his co-defendants’ reasons for staying in the country (jobs, businesses, and families) were “utterly unpersuasive” and they can be extradited to the United States to face charges there. The panel also rejected the defendants’ argument that the district court which ordered the civil forfeiture in 2015 lacked jurisdiction over property in another country.

The American government claim that Dotcom and three co-accused MegaUpload executives cost the entertainment industries more than $500 million in damages, while generating more than $175 million in profits, as the platform encouraged paying users to store and share copyrighted content, including films, music tracks and TV shows.
