BREIN Demands Dutch ISPs Block The Pirate BayAdded: Tuesday, June 1st, 2010

That is an ongoing battle in the Netherlands. In 2009 anti-piracy outfit BREIN brought 3 of the website’s owners to court while trying to shut down The Pirate Bay in this country. BREIN’s attorneys argued that the BitTorrent tracker is liable for millions of daily copyright violations, and therefore should be blocked to users from the Netherlands.
That case was won by BREIN and the court ruled that Peter, Gottfrid and Fredrik block Dutch visitors as soon as from the beginning of March this year unless they want to face fines of 5 thousand euros each, per day. The three site founders claimed they weren’t liable for the tracker’s operations anymore, but did not appeal the ruling. However, they really were not involved with the website any longer and therefore didn’t have any power to block it to the Netherlands. So far, The Pirate Bay is still accessible in the Netherlands.
The movie industry decided to use another technique able to make websites blocked. Following the example of in several other countries, BREIN switched to going after Internet providers.
Recently it has begun threatening Ziggo ISP trying to force it to block the world’s largest BitTorrent tracker. BREIN probably chose Ziggo because it’s the largest cable ISP in the country, with revenue reaching 1.3 billion euros last year from 7.2 million customers.
The reasons anti-piracy outfit brings to Ziggo demanding it to implement a block include the following: the website is guilty of large-scaled copyright violation with owners having been convicted and refuses to cooperate with copyright owners to solve piracy issues. The last reason is that it’s very easy for the ISP to block the tracker using simple measures.
What BREIN exactly wants Ziggo to do is to force a DNS and IP address block of the BitTorrent tracker. Moreover, it requires the ISP to block any future domain names and IPs of the website within one day after receiving a notification by BREIN. That is the same demand that of Italian court order, and is easy to bypass for willing users.
As for Ziggo, its representatives admit they would refuse to comply with BREIN’s request as it has no legal basis for it. An ISP is always only an intermediary which provides users access to the web and that’s all. It has nothing to do with the websites existing in the Internet. Besides, Ziggo announces to favor public Internet.

Also the "former" owners of Pirate bay are still liable for what goes on in the PirateBay name?
That is like me selling you my car and you go run over some one and they hold ME liable. Doesn't make sense..

|I`m a Sicko user, i hope this doesn`t come as far as blocking sites...sometimes DLs suddenly stop and all lines go down..i`m not sure if Sicko is behind this..i hope they stay with the favor for public internet..|
