|German court has ruled that a file-hosting service Uploaded.net can be liable for pirated materials shared by its customers, even when the copyright takedown notices didn’t get through its spam filters.
Uploaded is known as one of the largest file-hosting sites in the world, accounting for millions of monthly visitors. Like any other hosting service, it is used to share copyright infringing content, which annoys a lot of copyright holder groups. As a result, the service faced several lawsuits in Germany, where copyright owners accused Uploaded of facilitating copyright infringement of its users, because it failed to respond properly to DMCA takedown notices.
Now the court agreed that Uploaded could be held liable for a copyright breach even if takedown notices were filtered by spam filter and never read. An anti-piracy firm proMedia GmbH launched this case a few years ago. The firm explained it sent a DMCA notice to Uploaded and asked it to remove a specific file, but that never happened. In response, the cyberlocker explained that it had never received or read the message, as it was flagged as spam.
The German court refused to accept it as a reasonable excuse, because Uploaded’s anti-DDoS system willingly created a “cemetery for emails”. This particular lawsuit dealt with the liability question only, so the copyright holders will have to file another suit to obtain damages.
In any case, it definitely makes it harder for hosting services to operate without a solid anti-piracy strategy, because they are not only obliged to remove links immediately after having received a request from the copyright holders, but have to keep their services clean from infringing materials as well.
