Time Warner Cable (TWC) fights back against the argument of the USCG about having no outer limit of the amount of IP address subpoenas that the company can reasonably handle each month. It also notes that the USCG’s requests are substantially larger as compared to any copyright lawsuit, so the law firm has to accept that TWC is not able to process such great volume of mass litigation requests.
While the USCG, a DC-based company, is attempting to develop a new business model intended to target several thousands of alleged BitTorrent downloaders at a time, the TWC is trying to rebut it, keeping saying in the brief with the judges that the company can only handle 28 IP lookups a month. This is quite a problem for the U.S. Copyright Group as it has delivered at least 1,500 IP addresses to TWC for now, which means that with this speed of 28 requests per month they will be all done only in about 4 years.
Thomas Dunlap, the USCG’s attorney, changed his mind from accepting 28 subpoenas to requiring 800 instead, and after he hadn’t got the expected result, he went so far as to accuse the TWC of facilitating the copyright violation of its users and argue that an ISP can’t have any outer limit to the requests it can handle per month. Finally, he said that opposing the U.S. Copyright Group is considered an attempt to attract public support and get more subscribers valuing ISP’s efforts to defend the freedom of copyright infringers.
Time Warner argues back that the law firm’s requests are considerably larger than any other copyright lawsuits, particularly when a single request contains almost a thousand of IP addresses. The ISP tries to explain that it gets over 500 IP lookup requests every month, and almost all of them come from the law enforcement. But in comparison with the USCG’s subpoenas, some of those requests can be emergency ones connected with serious physical injury or even death. That means that complying with the law firm’s requests would make it distract substantial resources from responding to law enforcement lookups.
Finally, Time Warner asked the U.S. Copyright Group to reimburse it for the costs connected with responding its requests. In respond, the USCG argued that ISP has internal employees working on the requests who are getting paid regardless whether they are working on its subpoenas or not.
The fight continues and pleases everyone with the fact that USCG’s efforts of mass litigation are becoming more complicated.

|First of all, the internet is PUBLIC DOMAIN, any one who facilitates the use of said internet via means of their design, is said to be performing a public service in return for capital gains aka MONEY. None of these organisations seeking "damages in terms of monetary compensation" has the RIGHT to force any business to hand over PRIVATE INFORMATION about their clients; i.e. medical and legal professions, clergy, any type of business that has sensitive information on file. Our rights are being slowly eroded by a sham system of legal presidence that has no fact or basis period. Money is an institution-based system that changes constantly with advents of technology, nothing is permanent, nothing is forever, like the war on drugs, terrorism, and ideological religous based government cash crop fiasco's, these to, shall pass into the night like a flicker of flame soaked in a hurricane. The problem is acceptance of this concept. People are people, no matter who they are or where they are from, we are NOT just numbers, money statistics, finances lost, profits not weighed or measured, we are the REALITY. Money, power, and status can burn out and fade away, but life education lasts forever. Imagine digging a hole and filling it up, over and over and over and over, that is what these corporations do on a daily basis, ingrained room temp and shoe size IQ's are their main foundation. Time Warner is an international multi-BILLION Dollar a year company.
Just think they might just piss off T.W enough to either stomp or squash these puke lawyers for annoying them and making claims bodering on slander and libel...
