The trial sessions against the ShareConnector peer-to-peer site are going to fail for the Dutch Department of Justice. It was decided to reinvestigate the case and convenes the attorney as it challenges the legality of the penal actions and the fact that it operated due to the incriminating circumstances given by BREIN (organization against piracy).
Being one of the biggest peer-to-peer sites in 2001, ShareConnector swooped in 2004. Beginning with that time the owner fights with civilian and flagitious nature.
In 2007 the ShareConnector won the trial and was freed from all charges. But in two year the Department of Justice appealed against it. The owner aDi was accused with criminal relations with the organizations that illegally share the authorized material.
Two months later the Court of Hague concluded to start again the trial procedure. In an unusual manner R. Smits being the attorney became an attestor.
It wanted the attorney to comment why the Department of Justice elected criminal instead of civil proceedings. Civil proceedings related to unauthorized distribution are held in the Netherlands, being very severe.
The Court also has mentioned that the proofs were compiled by BREIN but not by the local administration.
For several times the solicitor for the respondent has raised the question of BREIN “usage” of the Department of Justice. And so, in 2007 the owner of the ShareConnector was freed.
The jury award decided that there was neither enough evidence to charge the copyrighting nor enough proof of it being illegal. To add to all these the Court stated the initial arrests to be illegitimate as the clues given by BREIN were poor.
There will be no amazement if aDi wins again.
In his comments he said that all is going to the judgment at law to defend the accused due to the fabricated evidence.
Is the world ready to face the major fiasco of the Department of Justice? The hope remains it will not take another 6 year to reveal the truth.

|for peolple like us it's just a simple matter of downloading a movie or game but its hard to believe that people have to undergo legal complications for what is a simple day to day matter for us. hundreds of people die due to T.B, HIV aids,malaria etc. but these people are more concerned about copyright infringement. suckers|

I mean, hell... after Chris Weitz gets his 100Mil from his payheck for Twilight (or is that from New Moon, no.. maybe Eclipse... well hell maybe he got that much atleast from each)... he will realize that he just doesnt have enough to pay the mortage, oops no, mortages.. and that new boat, and fuel for his private jet AND STILL BE ABLE to make a donation to the United AIDS Fund (or whatever charity he writes off his taxes)....and its all because these damn P2P Pirates shorted him a million... Some little kid is gonna go hungry because of us...
