A few days ago, US District Judge John Preston Bailey decided that committing the same type of copyright violation is not a sufficient reason to link all defendants in a single lawsuit. Besides, he ruled that the Adult Copyright Company narrow the list of defendants to only those having an IP registered within the court’s jurisdiction of the State of West Virginia.
Now the Adult Copyright Company is another representative of entertainment industry that has suffered a setback to 7 mass BitTorrent lawsuits, despite the fact of being self-proclaimed as a market leader in fighting piracy. The company made an attempt to argue that the file-sharers named in the mass lawsuit are properly joined together. However, District Judge John Preston Bailey disagreed with their statement, saying that this can’t be the reason. In addition, he pointed out that several courts agree that the defendants can’t be joined together if there’s no allegation that they have acted in concert. Therefore, each individual defendant is likely to have a different defense of the charges to be able to argue their individual cases on their own merits.
In short words, Judge Preston dismissed all subpoenas submitted except one. He also gave the Adult Copyright Company a month to refile the corrected complaints against the individual file-sharers it would like to continue suing. Meanwhile, Judge Preston took another step of narrowing the eligible defendants to only those having an IP registered within the court’s jurisdiction of the State of West Virginia.
As you might remember, another District Judge Rosemary Collyer issued the same ruling to similar mass BitTorrent lawsuits in December, saying the USCG should limit defendants to only those whom the plaintiffs reasonably believes the Court has personal jurisdiction over.
EFF described this ruling as “another nail in the coffin of the copyright trolls”, saying that since the judges started to reject the tactics employed by the entertainment industry, such type of mass litigation will likely become a bad business model soon. The reason is that by rejecting plaintiffs to lump together thousands of individual defendants, they raise the cost of litigating, particularly if each asks for a trial rather than settling.

|No truer word were ever spoken Chazzo125. They (corporations and the mega rich) may have the majority of the world's wealth, but "We The People" are the ones who really have the power. Since we are realizing the power that we have as one world and one people the elitist and their puppets are running scared. They know that people are waking up en masse and they are scared. Americans are tired of there being very few elected politicians that actually serve the people, so we have to watch out for and take care of one another. We are doing this by giving and sharing and will continue to do so and that is why they are doing everything in their power to stop us. If you all do not believe me just look at the legislation the U.S. supreme court passed last year. Big business and the rich now have no limits on how much they can contribute to politicians running for office, thanks to the neocon supreme court justices, so who will those politicians represent? Let's face it family; the United States of America is now a plutocracy and all we have is each other. No matter what your race, religion, or culture you mean nothing to them and their quest for total world enslavement. We all are one world, one family, the human family. Keep up the fight!||
