A sad day for the US if the Espionage Act is used against WikiLeaks
Numerous US officials are calling for a resurrection of the US Espionage Act as a tool for prosecuting WikiLeaks. The dusting-off of the old law is all but certain. But the outcome of the constitutional dust-up that is sure to follow will result in triumph or tragedy for the US bill of rights.
In 1917, in the midst of a war hysteria, the United States passed the Espionage Act. The law has nothing to do with prosecuting spies. From its inception, it had everything to do with suppressing dissent. The Great War was unpopular with many Americans, very like today's engagements in Iraq and Afghanistan.
Make no mistake about it. The Espionage Act targeted political dissidents. Senator Kenneth McKellar of Tennessee offered a simple defence of the law when it was introduced to Congress: "If we cannot reason with men to be loyal, it is high time we forced them to be loyal." Others, such as Congressman William Green of Iowa, were more blunt. His statement resembled modern calls supporting the execution of the suspected WikiLeaks "whistleblower" Bradley Manning: "For the extermination of these pernicious vermin no measures can be too severe."
The Espionage Act wreaked havoc on the American political left, destroying the young American Socialist party and one of its most progressive unions, the Industrial Workers of the World. Many others, including intellectuals, journalists, film producers and pacifist religious figures were also prosecuted. Prison terms were long, and some political prisoners died in federal jails. The abuses under the law were legendary, and mark a sad day in US history.
Why is the threat to prosecute WikiLeaks under the Espionage Act so potentially destructive? The law is not restricted to properly prohibiting the release of classified information. The law is not restricted to protecting legitimate government secrets. The law broadly prohibits any publication by anyone (newspapers included) of information related to national security, which may cause an "injury to the United States".
Who determines whether national security is actually at stake? Who determines what constitutes an "injury to the United States"? In 1917 the courts bent over backwards to permit the justice department to indict and prosecute thousands of dissidents. Loyalty to America meant nothing. The first amendment's protections for freedom of speech were mocked. Opposition to US war policies dictated who was jailed.
There are responsible mechanisms policing truly abusive leaks. The Espionage Act is not such a tool.
The attorney general should stop trying to resurrect the Espionage Act, and instead dust off his copy of the US constitution. If he has any question as to the meaning of the first amendment, he should read James Madison's 1789 speech, in which he introduced the bill of rights in the first Congress of the United States: "Freedom of the press, as one of the great bulwarks of liberty, shall be inviolable."
Wikileaks founder Julian Assange is granted bail
The founder of whistle-blowing website Wikileaks, Julian Assange, has been granted conditional bail by a judge.
The 39-year-old was granted bail in London earlier this week but prosecutors objected to the decision and he remained in jail.
The Australian is fighting extradition to Sweden over sex charges involving two women. He denies the allegations.
Mr Justice Ouseley granted conditional bail at the Royal Courts of Justice and supporters put up £240,000 in sureties.
Mr Assange's solicitor, Mark Stephens, said afterwards the bail appeal was part of a "continuing vendetta by the Swedes".
He said: "We have won costs today but they should be paid by Sweden not the hard-pressed Crown Prosecution Service."
Gemma Lindfield, representing the Swedish authorities, had told the judge there was "a real risk" Assange would abscond and pointed to his nomadic lifestyle.
She said he had "the means and ability" to go into hiding among Wikileaks' many supporters in this country and abroad.
But Mr Justice Ouseley pointed out Mr Assange had offered to meet the police in London when he heard the Swedish matter was still live and he said: "That is not the conduct of a person who is seeking to evade justice."
Earlier, the judge made a ruling banning the use of Twitter to give a blow-by-blow account of Thursday's proceedings.
The ruling was made just before 1300 GMT but it is understood it may take up an hour to process his release paperwork.

thats good news,or is it.
good to see he is free for the moment ot fight the extridtion case, but now with some more info I have found out about wikileaks and the cablegate saga I am begining to wonder what is going on inside the wikileaks camp.
Firstly I know sites like this have costs to meet and servers to keep running to help spread the information, but it seems they were approaching the media pre cablegates leak looking to sell the info contained in the cables to them.
"An intermediary asked for $100k for 'production costs.' We declined. We investigated but could not prove the money was to go to Julian Assange or Wikileaks. It seems a British public interest production company produced news pieces for BBC and Channel 4 based on access to the material. Al Jazeera paid 60k British pounds. BBC paid 100k, Channel 4 160k. Again, we couldn't prove any of it went to Assange."
and secondly it seems that wikileaks have removed certain cables and then re released them but in a censored version?? I havent had time to check this out in full but if this is indeed the case then why? after all the intention of these cables being leaked was to show an uncensored "Truth" of what our goverments were up to.
Statement from Director of Prosecution, Ms. Marianne Ny
At a hearing on Thursday 16 December, The High Court in London decided that Julian Assange should be granted bail. From the Swedish prosecutor’s perspective, the decision does not change the state of the case itself.
- As I have already stated I cannot, at the moment, provide information concerning the development of the matter. The question concerning surrender is handled by British authorities, says Director of Prosecution Ms. Marianne Ny.
As soon as new information can be released, it will be published on the web site www.aklagare.se.
Facts about extradition of a person who has been surrendered
Different rules apply within the EU (surrender) and outside the EU (extradition).
Due to general agreements in the European Arrest Warrant Act, Sweden cannot extradite a person who has been surrendered to Sweden from another country without certain considerations.
Concerning surrender to another country within the European Union, the Act states that the executing country under certain circumstances must approve a further surrender.
On the other hand, if the extradition concerns a country outside the European Union the authorities in the executing country (the country that surrendered the person) must consent such extradition. Sweden cannot, without such consent, extradite a person, for example to the USA.

Noam Chomsky: WikiLeaks Cables Reveal "Profound Hatred for Democracy on the Part of Our Political Leadership"
"In a national broadcast exclusive interview, we speak with world-renowned political dissident and linguist Noam Chomsky about the release of more than 250,000 secret U.S. State Department cables by WikiLeaks. In 1971, Chomsky helped government whistleblower Daniel Ellsberg release the Pentagon Papers, a top-secret internal U.S. account of the Vietnam War. Commenting on the revelations that several Arab leaders are urging the United States to attack Iran, Chomsky says the latest polls show "Arab opinion holds that the major threat in the region is Israel, that’s 80 percent; the second threat is the United States, that’s 77 percent. Iran is listed as a threat by 10 percent... This may not be reported in the newspapers, ... but it’s certainly familiar to the Israeli and the U.S. governments and to the ambassadors... What that reveals is the profound hatred for democracy on the part of our political leadership."

WikiLeaks Set To Reveal US-UFO War In Southern Ocean
By: Sorcha Faal, and as reported to her Western Subscribers
A new report circulating in the Kremlin today prepared for President Medvedev by Russian Space Forces (VKS) 45th Division of Space Control says that an upcoming WikiLeaks release of secret US cables details that the Americans have been “engaged” since 2004 in a “war” against UFO’s based on or near the Continent of Antarctica, particularly the Southern Ocean.
According to this report, the United States went to its highest alert level on June 10, 2004 after a massive fleet of UFO’s [photo 2nd left, click for video here] “suddenly emerged” from the Southern Ocean and approached Guadalajara, Mexico barely 1,600 kilometers (1,000 miles) from the American border. Prior to reaching the US border, however, this massive UFO fleet is said in this report to have “dimensionally returned” to their Southern Ocean “home base”.
The fears of the Americans regarding these Southern Ocean UFO’s began, this report says, during the unprecedented events of July 11, 1991 (referred to as 7/11) when during the Solar Eclipse these mysterious aircraft appeared by the hundreds over nearly all of Mexico, even their Capital city. Most notable about the events of 7/11 were that as millions of Mexicans were watching on their televisions the National broadcasts [click for video here] of these UFO’s over Mexico City, the American media refused to allow their people to view it.
Since 2004, this report continues, fleets of Southern Ocean UFO’s have continued to emerge from their bases, with the latest such event being this Friday past when another of their massive fleets was sighted over the South American Nation of Chile.
The “immediate danger” to our World when these massive UFO fleets emerge from the Southern Ocean, this report warns, are the massive waves caused by their sudden eruption from what are believed to be their underwater base, or bases. In the past week alone, the Clelia II, an Antarctic cruise ship with 160 people onboard, was nearly capsized [click here to see video] when hit by waves generated by these UFO’s emerging from the Southern Ocean, and just today the Number One Insung has been reported sunk with only 20 of its 42 member crew said saved due to the same cause.
Interesting to note in this report is its confirming our October 14th report US Shuts Down New York City Airspace Over UFO ‘Threat’ that these same Southern Ocean UFO’s were responsible for the closing of the airspace over New York City this past fall (October 13th) when they “appeared” openly and were witnessed by tens of thousands of people, and which, coincidentally, occurred during the same time frame as the mysterious Crystal Skulls of the ancient South American peoples were being exhibited there too.
Even more interesting to note is that the mysterious earthquakes being reported in the Gulf of Aden (where another “extraterrestrial” event is currently ongoing and we had reported on in our December 1st report Mysterious ‘Vortex’ Warned Is Creating Global Weather Catastrophe) are now being reported occurring in the Southern Ocean too.
This report goes on to state that after WikiLeaks founder Julian Assange warned last week that he would begin releasing secret US cables relating to these Southern Ocean UFO’s, and the Americans “war” against them, he was immediately arrested by British Police on trumped up charges issued by the Swedish government which in our December 8th report, Global Rebellion Erupts After “Unprotected Sex Meets Disrobed Governments”, we noted were engineered against him as a “classic” CIA “Honey Trap”.
Note: Since our last report on the EU-US frame-up of Assange it is now being reported that one of his two accusers, Anna Ardin, has fled Sweden and is now in hiding in the Palestinian territories.
To if Assange, or his WikiLeaks website, will survive to see the whole release of these Southern Ocean UFO files it is not to our knowing, nor does this report say.

Now that Assange has been released from prison. Maybe someone will shoot and kill him. One can only hope. asbo I'm glad to see that your so concerned about our U.S. laws, which really does not concern you. Try worrying about your own corrupt government in the UK for once. Again you can do nothing about all this, but get yourselves worked up for nothing. Nothing. Nothing you learn from wiki-leaks will do you any good in life. Just the knowledge of it all. That's it. Nothing. Ooh ooh guess what I found out now...and then they said...and then this happened....okay now you know. Okay now what? This whole thing is quite laughable. Keep it going I need a good laugh at someone. LOL now Yogi's talking UFO's. You guys are hilarious.

PMSL, coined a phrase 10 years prior to event
"The fears of the Americans regarding these Southern Ocean UFO’s began, this report says, during the unprecedented events of July 11, 1991 (referred to as 7/11) when during the Solar Eclipse these mysterious aircraft appeared by the hundreds over nearly all of Mexico"
We were not worried about the UFO's, it was the aliens we were trying to keep from "visiting" us. The video shows six buses of migrant mexican farm workers trying to slip over the border. The UFO comes from what the border patrol sprays on the buses, "Undocumented Folks Onboard", makes it a little easier to spot from the air that way.
I love the fact that all the other countries like to tell the Americans what our government is hiding. I think you are all still pissed about the CIA killing Princess Di, or the deportation of Yahoo Serious, or the fact that a secret US agency forced Beckham to marry a SPICE girl.
I just truly hope the wikileaks start to break the big news. Like why was Jimmy Hoffa and Elvis on the set at area 51 while the Apollo landing was being filmed, and the most important one I would like to know before I go to my deep eternal slumber, Who the fuck DID frame Roger Rabbit.
Hope all those and more will be reveled soon. I also heard if you fold Assange's release papers so the arrows line up it shows a picture of Jesus riding in a smart car with Alfred E. Neuman.

LoL .. i did get carried away on the last post, the war on UFO's has no credible sources, but is that the result of the mainstream media wanting us to know what they want us to know?
I'm sorry if the Yanks are upset at some of these posts
