XBOX 360 OLD HITATCHI DRIVE PROBLEM

i would like a bit of help regarding this matter if anyone could actually tell me anything that could help

My issue is that i had to let the new dashboard update reset my drive back to stock as i didnt have the original drive key for this xbox, so now M$ have assigned me a new key??? so seeming as there is no new firmware for the hitatchi i can flash back to 1.1 and play again, but would this flag my console now that i accepted the update and ms changed my key? i dont want to get it banned yet, because ive also heard the hitatchi drives cant support the new xgd3 format is that true? in other words i dont want to get a ban if i can get a free xbox out of this lol.

any help on this matter would be much appreciated cheers
